| Abstract | ||
| The lack of equity in asylum responsibility-sharing within the EU has been a recurrent issue that requires immediate attention. This paper aims to contribute to the ongoing debate on European solidarity tools from a constitutional law standpoint, using the ideal of solidarity and fair sharing of responsibility as its starting point, as stated in Article 80 TFEU. This approach is viewed as a crucial strategy in both increasing justice in responsibility-sharing and protecting refugees, according to the article. It argues that the principle of sharing responsibility and the principle of mutual trust have sparked widespread controversy on the international scene between supporters and opponents, and about their effectiveness in ensuring a minimum level of protection for asylum seekers and refugees. لا يمثل النزوح القسري اليوم والأعداد المتزايدة من طالبي اللجوء أزمة إنسانية عالمية فحسب ، بل يمثل أيضًا تحديًا لأهداف التنمية المستدامة. ومع ذلك ، إذا بذل جميع أعضاء المجتمع الدولي قصارى جهدها لوضع حماية اللاجئين تقوم علي أساس قانوني ملزم ، فلن تكون هذه التحديات مستعصية الحل. وفي الآونة الأخيرة ، بدأ يظهر مبدآن دوليان يتعلقان بحماية طالبي اللجوء هما؛ مبدأ تقاسم المسؤولية ومبدأ الثقة المتبادلة. ولقد أثارت هذه المبادئ جدلًا واسعًا على الساحة الدولية بين المؤيدين والمعارضين ، وحول مدى فعاليتها في ضمان الحد الأدنى من الحماية لهذه الفئات الضعيفة. | ||
