| Abstract | ||
| يهدف البحث إلى بيان حقيقة المجمل، وهل وردت هذه الألفاظ المجملة في نصوص الكتاب والسنة؟ وبيان كيفية تعامل العلماء مع هذه الألفاظ المجملة، التي هي غير واضحة الدلالة على المراد منها، وكيفية دلالتها على الأحكام، وبيان حصر الأسباب التي تؤدي إلى الإجمال، وبيان الطريقة التي تناول بها العلماء النظر إلى تقسيم المجمل، فقد تباينت وجهات نظرهم في هذا الموضوع، وبيان كيفية تأثير أسباب الإجمال على وقوع الخلاف بين الفقهاء في الفروع الفقهية، ومن أهم النتائج التي توصل إليها البحث: أن المجمل في اللغة مأخوذ من الجمل وهو الخلط، أو هو المبهم، على أن أصل مادة الكلمة ترجع إلى التكثير والاجتماع، وانضمام الآحاد بعضها إلى بعض، وأن أوفى تعريفات المجمل في الاصطلاح وأخصرها وأكثرها دقة – في نظري – هو تعريف الإمام العلامة ابن الحاجب (~) وهو أن المجمل: ما لم تتضح دلالته، ولما كان المجمل غير واضح الدلالة على المراد منه، كان حكمه: أنه يتوقف فيه إلى أن يبين، ولا يصح الاحتجاج بظاهره في شيء يقع فيه النزاع، ورأينا من خلال العرض لأقسام المجمل عند ثلاثة من أئمة الأصول، كيف نظر كل واحد منهم إلى زاوية معينة، فقسم المجمل باعتبار ما ظهر له، واتضح من خلال هذا البحث أن أسباب الإجمال كثيرة، وأنها قد تزيد عن خمسة عشر سببًا، واتضح من خلال استعراض أسباب الإجمال، كيف أثرت هذه الأسباب على اختلاف الفقهاء في الفروع الفقهية، وقد ذكرت في البحث بعض ما وقع من خلاف بينهم بسبب ذلك. The research aims to clarify the reality of the total, and are these phrases outlined in the texts of the Book and the Sunnah? And an explanation of how the scholars deal with these summative terms, which are not clear in their intended meaning, and how they signify the rulings, and a statement of the reasons that lead to the summation, and an explanation of the way in which the scholars dealt with looking at the division of the total, their views differed on this subject, And an explanation of how the reasons for the totality affect the occurrence of disagreement among the jurists in the branches of jurisprudence, and the most important results reached by the research: The overall in the language is taken from the sentences, which is confusion, or it is ambiguous, provided that the origin of the word material is due to multiplicity and association, and the joining of units to each other, and that the most complete, shortest and most accurate definition of the terminology - in my view - is the definition of the imam, the scholar Ibn al-Hajib(~) which is that the aggregate: unless its significance is clear, and since the outline is not clear what is meant by it, its ruling was: that it depends on it until it becomes clear, and it is not valid to invoke its apparent meaning in something in which the dispute occurs, and we saw through the presentation of the sections of the aggregate at three of The Imams of the Fundamentals, how did each of them look at a particular angle, so he divided the sum according to what appeared to him, and it became clear through this research that the reasons for the summation are many, And it may be more than fifteen reasons, and it became clear by reviewing the reasons for the totality, how these reasons affected the differences of jurists in the branches of jurisprudence, and I mentioned in the research some of the differences that occurred between them because of that. | ||
