| Abstract | ||
| أن مفهوم براءة الاختراع رغم تعدد مفاهيمه هو الحماية القانونية بشقيها الشكلي والموضوعي الممنوحة للمخترع علي اختراعه من خلال براءة الاختراع، وما يميز براءة الاختراع عن غيرها من نماذج المنفعة والرسوم والنماذج الصناعية والمهارة الصناعية، كما أن الحماية الدولية لبراءات الاختراع شهدت العديد من التطور بداية من منح الامتيازات والحق في الاحتكار حتى ظهور أول معاهدة فعليه تتناول حقوق الملكية الصناعية، وهي اتفاقية باريس 1883مروراً بمعاهدة التعاون بشأن البراءات والاتفاقية الأوروبية لبراءات الاختراع وصولاً إلي اتفاقي التريبس(TRIPS) . الجهود المبذولة للدول الصناعية المتقدمة والشركات الكبرى في بسط الحماية الدولية لأنظمة براءات الاختراع كأداة للتنمية الاقتصادية والتقنية، ففي الغالب تكون تلك الأنظمة عبء علي عاتق الدول النامية لفترات محدودة لتعديل قوانينها الوطنية بشكل يتلائم مع النظام الاقتصادي الجديد. The concept of the patent, despite the multiplicity of its concepts, is the legal protection in its two parts, formal and substantive, granted to the inventor for his invention through the patent, and what distinguishes the patent from other utility models, industrial designs and industrial skills, and the international protection of patents witnessed many developments starting from the granting of Privileges and the right to monopoly until the advent of the first actual treaty dealing with industrial property rights, which is the Paris Agreement of 1883, passing through the Patent Cooperation Treaty and the European Patent Agreement, leading to the TRIPS Agreement. Efforts made by advanced industrial countries and major companies to extend international protection to patent systems as a tool for economic and technical development. Often these systems are a burden on developing countries for limited periods to amend their national laws in a way that is compatible with the new economic system. | ||
