| Abstract | ||
| تناول هذا البحث الطبيعة القانون للمسئولية المدنية عن الأضرار الناشئة عن أعمال شغب الملاعب التي يسببها نشاط الهيئات الرياضية من اتحادات وأندية ومنظمات رياضية أو تقع بفعل المساهمين في النشاط الرياضي من لاعبين وحكام ومدربين وإداريين؛ حيث سلط البحث على طبيعة القانون للمسئولية المدنية عن الأضرار الناشئة عن أعمال شغب الملاعب؛ وقد توصلت إلى أن مسئولية النوادى الرياضية يمكن أن تقوم على أساس المسئولية التعاقدية أو التقصيرية؛ كما تناول البحث الالتزام بضمان السلامة لما له من أهمية في التمييز بين هاتين المسئوليتين؛ وكذلك لا تقتصر هذه المسئولية على النوادى الرياضية فقط بل يمكن أن تمتد إلى جميع المشاركين فى النشاط الرياضى؛ حيث تناول البحث خطأ اللاعبين وخطأ الجمهور وخطأ الإداريين ومدربى الفرق وخطأ منظمى الأنشطة الرياضية . ولنا أن نتساءل اذا ما كان النادى الرياضي يتحمل المسئولية وما هي الشروط اللازمة لقيام هذه المسئولية، وما هى الصيغة القانونية لهذه المسئولية؟ حيث ركز البحث حول تساؤل رئيس ما هى الطبيعة القانونية للمسئولية عن شغب الحوادث الرياضية؟ ولقد استخدمت الباحثة في هذا البحث المنهج التحليلي، وذلك من خلال تحليل النصوص القانونية المتعلقة بموضوع الدراسة، وأيضا المنهج المقارن للوقوف على موقف التشريعات المقارنة في موضوع البحث. وتوصل البحث إلى توصيات جاءت كالتالى: أولاً: نهيب بالمشرع المصرى ضرورة التدخل من أجل إضافة نصوص قانونية تتعلق بتحديد طبيعة المسئولية الرياضية فى حالة وقوع شغب ناجم عن ممارسة الأنشطة الرياضية. ثانيا: ضرورة إنشاء محكمة رياضية على غرار محكمة الأسرة أو المحاكم الاقتصادية دون الاكتفاء بمركز التسوية والتحكيم الرياضى المصرى المنصوص عليه في قانون الرياضة المصرى الجديد. / In light of the manifestations of riots in the stadiums when practicing sports activities of all kinds; This riot may result in riots involving all participants in the sporting activities. In this research, I dealt with the legal nature of civil liability for damages arising from stadium riots caused by the activity of sports bodies such as federations, clubs and sports organizations, or by the actions of participants in sports activity such as players, referees, coaches and administrators; Where the research highlighted the nature of the legal nature of civil liability for damages arising from stadium riots. In this research, I concluded that the liability of sports clubs can be based on contractual or tort liability. The research also dealt with the obligation to ensure safety for an issue because of its importance in distinguishing between these two responsibilities. Also, this responsibility is not limited to sports clubs only, but may extend to all participants in sports activity. Where the research dealt with the error of the players and the error of the audience and the error of the administrators and coaches of the teams and the error of the organizers of sports activities. We may ask whether the sports club bears the responsibility and what are the conditions necessary for this responsibility to be established, and what is the legal formula for this responsibility? Where the research focused on a major question, what is the legal nature of responsibility for rioting sports accidents? In this research, the researcher used the analytical approach, by analyzing the legal texts related to the subject of the study, as well as the comparative approach to find out the position of comparative legislation in the subject of the research. The research reached recommendations as follows: First: We urge the Egyptian legislator to intervene in order to add legal texts related to determining the nature of sports liability in the event of a riot resulting from the practice of sports activities. Second: The need to establish a sports court similar to the family court or economic courts, without being satisfied with the Egyptian Sports Settlement and Arbitration Center stipulated in the new Egyptian Sports Law. | ||
