| Abstract | ||
| أهداف الدراسة: يعتبر نظام الملكيَّة الشائعة سببًا لوجود الكثير من المشاكل والخلافات القانونية بين الشركاء على الشيوع، لذلك نظم القانون المدني الكويتي كيفية استعمال المال الشائع واستغلاله وطريقة إدارته والتصرف فيه؛ وذلك لمنع استئثار بعض الشركاء بمنافع المال الشائع دون باقي الشركاء، وحدد السلطات التي تخولها الملكيَّة الشائعة للملاك على الشيوع، وأعطى لكل شريك الحقَّ في إنهاء حالة الشيوع وطلب قسمة المال الشائع ما لم يكن مجبرًا على البقاء في الشيوع بمقتضى القانون أو الاتفاق، إلا أنه غفل عن تنظيم مسألة كثيرة الحدوث في الواقع العملي وهي «وضع أحد الشركاء يده على كامل العقار المشاع وانفراده وحده دون موافقة باقي الشركاء باستعماله واستغلاله». لذلك جاءت هذه الدراسة لبيان الحكم القانوني لهذه المسألة من خلال استعراض الاتجاهات الفقهيَّة والقضائيَّة التي تتنازعها، ومناقشتها وتبني أكثرها تحقيقًا لقصد المُشرِّع ولمصلحة الشركاء على الشيوع. منهجية الدراسة: تعتمد الدراسة على المنهج الوصفي التحليلي لنصوص القانون المدني الكويتي، مع استعراض الاتجاهات الفقهيَّة وما يؤيدها من أحكام قضائية لمحكمتي التمييز الكويتية والفرنسية ومحكمة النقض المصرية، والحلول التي تبناها القانون المقارن لتعويض الشركاء الذين حرموا من الانتفاع بالعقار الشائع. نتائج الدراسة: خلصت الدراسة إلى أنه ليس في القانون المدني الكويتي ما يمنع الشريك في العقار الشائع من أن يحوز حصص باقي شركائه المشتاعين على وجه التخصيص والانفراد بنية تملكها، إلا أن الطبيعة الملتبسة لحيازة الشريك لباقي حصص الشركاء ورفض المُشرِّع الكويتي الأخذ بفكرة القسمة المفترضة، وبعض الاعتبارات التي تفرضها العلاقة الاجتماعية بين الشركاء وطبيعة الملكيَّة المشتركة تؤدي إلى تغليب الرأي القائل بعدم سريان أحكام الحيازة على الملكية الشائعة, واعتبار انفراد الشريك باستعمال العقار الشائع أو استغلاله الشائع وحرمان باقي الشركاء من الانتفاع بحصصهم أو الحصول على غلتها - من قبيل التعدي الذي يعطي لهم الحق في إقامة دعوى قضائية للمطالبة بإيقاف الشريك عن ممارسة الأعمال التي تشكل تعديًا والمطالبة في الحصول على مقابل انتفاع الشريك بما جاوز حصته من العقار الشائع. / Objectives of the study: The system of common ownership is considered a reason for the existence of many problems and legal disputes between the undivided co-owners, so the Kuwaiti Civil Law regulated how to use and exploit common property and the method of managing and disposing of it, in order to prevent some undivided co-owners from monopolizing the usufruct of undivided property to the exclusion of the rest of the undivided co-owners, and specifying the powers that the Common ownership entitled to the undivided co-owners, and gave each owner the right of ending the co-ownership and requesting the division of the common property unless he was forced to maintain in the co-ownership by law or agreement, unless he neglected to regulate an issue that frequently occurs in actual practicality, which is one of the co-owners taking possession of the entire common property, using and exploiting it, without the consent of the rest of the co-owners. Therefore, this study clarifies the legal provision on this issue by reviewing the conflicted jurisprudential and judicial opinions, discussing them, and adopting the most of them for the intention of the legislator and the interest of the co-owners over the ownership. Study methodology: The study adopts the descriptive and analytical approach of the provisions of the Kuwaiti civil law, with a review of the jurisprudential opinions and what confirmed them from the judicial provisions of the Kuwaiti and French Courts of Cassation and the Egyptian Court of Cassation, and the solutions adopted by the comparative law to compensate the co-owners who were denied the usufruct of the common property. Results of the study: The study concluded that there is nothing in the Kuwaiti civil law that prevents the co-partner in the common property from possess the undivided interest of the rest of his co-owners privately and individually with the intention of owning it. However, the ambiguous nature of the co-partner’s possession of the rest of the co-partners’ shares, the Kuwaiti legislator’s refusal to take into account the notion of the assumed division, and some considerations imposed by the social relationship between the co-partners and the nature of common ownership lead to the prevailing of the opinion that the provisions of possession do not apply to common ownership, and considering the partner’s severalty use of the common property or its common exploitation and depriving the rest of the co-partners from usufruct from their common shares or obtaining their yields, such as the infringement that gives them the right to file a lawsuit to claim that the co-partner be stopped from practicing the business that constitutes an infringement and to claim a consideration for the partner’s usufructuary of what exceeded his portion of the common property. | ||
