| Abstract | ||
| هذا البحث اعتمد فيه الباحث على المنهج الاستقرائي التتبعي التحليلي لمواد نظام الأحوال الشخصية مقارنة بين الوضع السابق قبل صدور النظام، وبعد صدوره، من أجل دراسة الأثر التشريعي للنظام في تقويم الإشكاليات المتعلقة بقضايا الحضانة، وكيف ساهم النظام في معالجتها، يظهر من خلال هذه الدراسة أثر النظام في مواكبة التطور التشريعي والذي يتوائم مع تطلعات المملكة وفق رؤية 2030، بما يحفظ حقوق الأفراد والمجتمع، ويضع نصوصًا منضبطة تمثل العدالة الاستباقية، وتضمن استقرار المجتمع وحماية أفراده، وقد اخترت موضوع الحضانة لما يمثله من أهمية للأسرة والمجتمع، كلبنة أساسية ورئيسة في تكوينه، وأثر ذلك على المجتمع ككل، وقد استهدف البحث التعريف بالجهود المبذولة لتطوير المنظومة الحقوقية المتعلقة بالأحوال الشخصية، وتوضيح السمات والمقاصد الرئيسة لنظام الأحوال الشخصية، وبيان الإشكاليات القانونية المتعلقة بأحكام الحضانة، وآثار النظام في معالجتها، والضمانات التي وضعها لحفظ الحقوق، وأداء الواجبات، وقد توصل الباحث إلى مجموعة من النتائج من أهمها: رغم تأخر المملكة في إصدار نظام مستقل يحكم مسائل الأحوال الشخصية مقارنة ببعض الدول الخليجية، إلا أنه تفرد عنها بعدة مواد تضبط نظام الحضانة وتسهم في حماية كيان الأسرة، راعي النظام الجديد أفضل الممارسات العربية التي تنظم مسائل الأحوال الشخصية بما يتسق مع الثقافة والأعراف المحلية. This research makes use of the inductive, follow-up and analytical approach to the articles of the Domestic Relations Law, comparing the previous situation before the issuance of the law, and after its issuance, in order to study its legislative impact on evaluating and solving the problems related to custody issues. I have chosen the topic of custody because of its importance to the family and society, as it is a basic and major building block, and because of its impact on society as a whole. The research aims to introduce the efforts made to develop Domestic Relations as a legal system and to clarify the main features and purposes of this system. It also clarifies the legal problems of court decisions related to custody, the effects of the Domestic Relations system in dealing with them, and the guarantees that it put in place to preserve rights and perform duties. The most important result of the research is that although the system governing Domestic Relations in KSA was issued as an independent system relatively late compared to Gulf countries, it is unique in several articles that regulate the custody system and contribute to protecting the family entity. | ||
