| Abstract | ||
| يهدف الباحث من دراسته إلى توضيح مفهوم الهبة، وما يتعلق بها من تطبيقات قضائية في القانون الكويتي وتطبيقات المحكمة المختصة في قضية الهبة، والخلاف الذي يحصل بين الزوجين في عقد الهبة بعد الفرقة، حيث يرجع الزوج الواهب عن هبته بسبب المنازعات بينهما، وهنا تكمن مشكلة البحث في إيجاد قوانين وأحكام للفصل بمثل هذه الإشكاليات لتكون المحكمة المختصة في الكويت قادرة على التعامل مع هذه المشكلات والقضايا وحلّها وإنهائها، ولا سيما بعد ارتفاع نسبة قضابا المحكمة الأسرية في الكويت في عام (2021) بنسبة 29.4% عن عام (2020)، وقد اتبع الباحث في دراسته المنهج التحليلي الاستقرائي، الذي يتناسب مع موضوع البحث، وخلص إلى عدد من النتائج والتوصيات، تمثلت بالتزام محكمة التمييز في الكويت بما جاء من تعديل قانوني بموضوع الهبة، فأصبحت تابعة لنصوص القانون المدني بدلًا من قانون الأحوال الشخصية، حيث نصّ القانون المدني الكويتي في مادته (537) أنه لا يجوز للواهب الرجوع في هبته إلا الأبوين فيما وهباه أو بعذر مقبول، أما أبرز ما ورد في التوصيات فكان ضرورة أن يتطرق الباحثون لهذا النوع من العقود بسبب قلة الأبحاث التي تناولته ونشرها بطرق يسهل على الإنسان الوصول إلى مثل هذه القضايا للتعرف والاستفادة منها. The researcher aims through his study to clarify the concept of the gift, its related judicial applications in the Kuwaiti law, the applications of the competent court, and the dispute that occurs between the spouses over the gift contract after separation when the donor husband withdraws his gift because of the disputes between them. The research problem consists in finding laws and rulings to adjudicate such problems so that the competent court in Kuwait can deal with, solve and end these problems and cases, especially after the increase in the percentage of family court cases in Kuwait in the year (2021) by 29.4% compared to the year (2020). In his study, the researcher follows the inductive analytical approach, which is commensurate with the subject of the research. The research concludes with a number of results and recommendations, represented by the commitment of the Court of Cassation in Kuwait to the legal amendment concerning the issue of the gift, which became affiliated with the Civil Law instead of the Domestic Relations Law. The Kuwaiti Civil Code, Article 537, states that the donor is not allowed to withdraw his gift except for the parents who may withdraw it if there is an acceptable excuse. | ||
