| Abstract | ||
| في بحثي هذا ركزت على بيان الرقابة الإدارية والقضائية للسلطة التأديبية لصاحب العمل، وذلك من خلال عرض أهم العناصر المرتبطة بهذا الموضوع ؛ حيث قمت أولا من خلال المبحث الأول إلى مناقشة الرقابة المفروضة على السلطة التأديبية، من خلال شرح الرقابة الإدارية على السلطة التأديبية على صاحب العمل عن طريق بيان أهمية تفتيش العمل بالإضافة إلى ذكر أهم السلطات التي يتمتع بها مفتش العمل وفق القانون والنظام المعمول به، والمبحث الثاني بشرح الرقابة القضائية على السلطة التأديبية لصاحب العمل التي تمثلت في عنصرين هما: الرقابة على مشروعية الجزاء التأديبي مع بيان المسوغات لذلك والرقابة على ملائمة الجزاء التأديبي، كل ذلك بالتطبيق على قانوني العمل بالمملكة العربية السعودية وجمهورية مصر العربية؛ من خلال شرح وتوضيح أهم البنود القانونية التي اهتمت بموضوع بحثي وبيان نقاط الاختلاف والاتفاق بينهما، وختاماً النتائج اللي تم استنتاجها والتوصيات، ومن أهم النتائج: أنَّ لـرب العمل سلطة تقديرية في مجال تقدير الجزاء التأديبي المناسب بشرط أن يكون ذلك الجزاء من بين العقوبات التي تم تحديدها قانوناً من خلال نظام العمل السعودي أو قانون العمل المصري، وأنَّ السلطة التأديبية تعد حقاً ذو صبغة قانونية يحظى به صاحب العمل في أي كيان قائم تحت تصرفه. This research focuses on explaining the administrative and judicial oversight of the employer’s disciplinary authority, by presenting the most important elements related to this topic. The first section discusses the oversight imposed on the disciplinary authority, by explaining the administrative control over the disciplinary authority over the employer. This is achieved by explaining the importance of labor inspection in addition to mentioning the most important powers that the labor inspector has in accordance with the applicable law and system. The second section explains the judicial oversight of the employer’s disciplinary authority, which consists of two elements: oversight of the legality of the disciplinary sanction, with a statement of the justifications for that, and oversight of the suitability of the disciplinary sanction. All of this is achieved in light of the labor laws in KSA and Egypt. Finally, the results and recommendations include that the employer has discretion in the field of assessing the appropriate disciplinary penalty provided that that penalty conforms to the Saudi Labor Law or the Egyptian Labor Law, and that the disciplinary authority is a legal right enjoyed by the employer in any entity at his disposal. | ||
