| Abstract | ||
| إن التغيرات المناخية من أخطر الظواهر الكونية التي تهدد البشر؛ لما تسببه من كوارث وأضرار لا يمكن تحملها، ومن الثابت في الإسلام تقرير مسؤولية البشر عن الأضرار الناتجة عن أفعالهم، حتى وإن لم تكن ناتجة عن خطأ، فالإسلام لا يعفي أحد من المسؤولية، ولقد دأب النظام الإسلامي لوضع الحلول لمثل هذه المشاكل والحد منها، وسبق الإسلام جميع النظم الوضعية في ذلك. ويهدف هذا البحث إلى الإلمام بصورة أكثر عمقًا بهذه الظاهرة الكونية الغريبة وإكسابها رؤية إسلامية جديدة من خلال إبراز مكامن الشريعة الإسلامية التي تساهم في الحد من هذه الظواهر، والتوصل إلى حل وطريقة للحد من أضرار التغيرات المناخية، فالبحث يسعى لمعرفة مدى إسهام النظام السياسي الإسلامي في الحد من أضرار التغيرات المناخية، فهي دراسة ترتكز على فكرة العدالة المناخية، والضوابط الشرعية والقانونية للاعتراف بمسؤولية الدولة عن أضرار التغيرات المناخية وآثار قيامها. ويعتمد البحث على المنهج المقارن القائم على الاستقراء والتحليل لمفردات الدراسة والنقول الفقهية المتفقة معها، وكذلك المنهج الوصفي. ومن أبرز النتائج التي توصل إليها البحث: - إقرار النظام الإسلامي بمسؤولية الدولة عن أضرار التغيرات المناخية. - أن مسؤولية الدولة عن أضرار التغيرات المناخية هي مسؤولية دينية بالأساس قبل أن تكون قانونية. ومن أبرز ما أوصى به البحث: - يوصي الدولة بالسعي إلى نشر تعاليم الإسلام التي تحث على المحافظة على البيئة والكون. اقترح على المجالس التشريعية وضع تشريع ينظم الأنشطة الصناعية وسائر الأنشطة التي من شأنها أن تضر بالمناخ. Abstract: Climate change is one of the most dangerous cosmic phenomena that threaten humanity due to the disasters and damages it causes, which are unbearable. It is a well-established principle in Islam that humans are responsible for the damages resulting from their actions, even if they are not caused by error. Islam does not exempt anyone from responsibility. The Islamic system has been accustomed to finding solutions to such problems and mitigating them, surpassing all other secular systems in this regard. This research aims to gain a deeper understanding of this strange cosmic phenomenon and provide it with a new Islamic perspective by highlighting the provisions of Islamic law that contribute to mitigating these phenomena and finding a solution to reduce the damages caused by climate change. The research seeks to determine the extent to which the Islamic political system contributes to mitigating climate change. It is a study based on the concept of climate justice and the recognition of the state's responsibility for climate change damages and their consequences. The research relies on a comparative methodology based on induction and analysis of the study's vocabulary, as well as consensus-based jurisprudential references, in addition to a descriptive approach. The research has reached the following key findings: - The Islamic system acknowledges the state's responsibility for climate change damages. - The responsibility of the state for climate change damages is primarily a religious responsibility before being a legal one. The research also recommends the following: -The state is advised to strive to spread the teachings of Islam that emphasize the preservation of the environment and the universe. It is suggested that legislative councils enact legislation to regulate industrial activities and other activities that may harm the climate. | ||
