| Abstract | ||
| نتناول في هذه الدراسة الوسائل القانونية في مجال تنفيذ أحكام القضاء الصادرة ضد الإدارة العامة وهي وسيلة الغرامة التهديدية، وتتجسد هذه الوسيلة في شكل مبالغ مالية تفرض في حالة التأخر عن التنفيذ، وتقدر وفق وحدة زمنية معينة. وكذا وسيلة توجيه أوامر للإدارة، والتي تكمن في الأمر القضائي الصادر عن القاضي الإداري الموجه إلى جهة الإدارة الممتنعة عن التنفيذ. ومدى سلطة القاضي الإداري في إقرار هاتين الوسيلتين في سبيل إجبار الإدارة على الاستجابة لأحكام القضاء. وذلك بتسليط الضوء على السلطات الممنوحة للقاضي الإداري في هذا الشأن. توصلنا إلى أن بعض الأنظمة القانونية كالنظام الفرنسي والجزائري كرست سلطات القاضي الإداري في لجوئه لفرض الغرامة التهديدية وتوجيه أوامر للإدارة بموجب نصوص قانونية. وهو التوجه الذي استقر بموجبه موقف القضاء الإداري سواء الفرنسي أو الجزائري، في حين هناك إغفال تشريعي لدى المشرع المصري ونظيره الأردني بخصوص هاتين الوسيلتين، وهو ما انعكس على موقف القضاء الإداري في كلا النظامين. Abstract: In this study, we discuss the legal means in the field of implementing judicial rulings issued against the public administration, which is the means of threatening fines, as well as the means of directing orders to the administration, and the extent of the powers of the administrative judge in approving these two means in order to compel the administration to respond to the rulings of the judiciary. By highlighting the powers granted to the administrative judge in this regard. We concluded that some legal systems, such as the French and Algerian systems, have now enshrined the powers of the administrative judge in his resort to imposing a threatening fine and directing legal orders to the administration. On the other hand, there is legislative omission by the Egyptian legislator and his Jordanian counterpart, which is reflected in the position of the administrative judiciary in both systems. | ||
