| Abstract | ||
| يهدف هذا البحث إلى بيان ما يرتبه خطاب الوضع من أحكام على غير المكلفين من الآدميين؛ وذلك لأنه لما كان خطاب التكليف يختص بمخاطبة المكلفين بما يجب عليهم، أو يندب، أو يحرم، أو يكره، أو يباح لهم كان غير المكلف أو من ارتفع عنه التكليف لعذر من الأعذار خارجاً عن هذا الخطاب، ولا يتوجه إليه إلا خطاب الوضع؛ لأنه لا يشترط له ما يشترط لخطاب التكليف من العقل، وفهم الخطاب، وغيرهما من شروط التكليف، فكان بمثابة القانون الذي يبين ما يجب على غير المكلفين من أحكام تتعلق بعقائدهم، وتصرفاتهم القولية، والفعلية، فيبين المسؤليات المتعلقة بأموالهم من نفقات على فقراء أسرهم، ونفقات زوجاتهم، وغرامة متلفاتهم، وجرائمهم، وما ذلك إلا أثراً لخطاب الوضع من حيث إنه يرتب المسبب على السبب دون نظر لحال الفاعل؛ حتى لا يفتح باب من الفساد لكل من أراد ارتكاب جريمة ما أن يدعي عذراً من الأعذار كجنون، أو عته، أو سكر، أو إغماء، وذلك فيه ما فيه من إظهار لتمام الشريعة، وكمالها؛ من حيث المحافظة على الأنفس، والأموال بتضمين الجاني جنايته، وإن كان غير مكلف، وقد بينت ذلك من خلال دراسة أحكام الصغير، والمجنون، والمعتوه، والسكران، والمغمى عليه، والمكره. Abstract: This research aims to explain the rulings that Khitab Alwad’ impose on the legally incompetent people, since Khitab Al Taklieef is concerned with addressing those charged with what is obligatory for them, recommended, forbidden, hateful, or permitted for them, the legally incompetent people or those not being legally competent due to any of the legal excuses is outside of this address, and shall be only addressed by Khitab Alwad’, as it does not require what is required for those who addressed by Khitab Al Taklieef in terms of reason, understanding of the address, and other conditions of the legal capacity, it was like a law that clarifies the provisions that are required of legally incompetent people related to their beliefs, and their verbal and actual actions, and it clarifies the responsibilities related to their money, such as spending on their poor family members, and spending on their wives, the fine for damages that they resulted, and their crimes, and that is only a result of Khitab Alwad’ in that it arranges the cause-and-effect relationship without regard to the condition of the person committed it; So that the way of corruption is not opened for anyone who wants to commit a crime to claim an excuse such as insanity, imbecility, drunkenness, or fainting, which demonstrate the completeness and perfection of the Sharia provisions, in terms of preserving lives and property by charging the offender with its crime, even if he / she was legally incompetent, the matter that i have demonstrated and clarified this through studying the rulings of the minor, the insane, the maniac, the drunk, the unconscious, and the person under coercion. | ||
