| Abstract | ||
| تهدف هذه الدراسة لبيان مذاهب العلماء والراجح في حكم تغير الفتوى، وللوصول لهذا الهدف عرض الباحث أدلة كل مذهب، وحرر مذاهب الأئمة الذين اخُتلف النقل عنهم كابن القيم والشاطبي، ثم أعقب هذا ببعض التطبيقات الفقهية لتغير الفتوى، وقد اتبع الباحث المنهج الاستقرائي التحليلي المقارن فجمع أقوال أهل العلم في تغير الفتوى، واستقرأ الأدلة، وقارن، وحلل، ورجح، ثم طبق ما توصل إليه على بعض مسائل الفقه، وقد توصل الباحث إلى نتائج منها: أن العلماء اختلفوا في مشروعية تغير الفتوى على مذاهب فمنهم من قال بالمنع، ومنهم من قال بتغير مأخذها، ومنهم من قال بتغيرها ولكن بلا ضوابط، ومذهب الجمهور أن الفتوى تتغير ولكن بشروط وضوابط، وأنه بعد فحص وتحليل الأدلة تبين للباحث أن القول الراجح هو قول جمهور أهل العلم، وتبين له صحة نسبة هذا القول للإمامين ابن القيم والشاطبي، وأن من تطبيقات تغير الفتوى الفقهية تغيرها في حكم خروج النساء للمساجد، وتغيرها في حكم الطلاق ثلاثًا بلفظ واحد، وتبين من التطبيقات أن الفتوى تتغير وأن تغيرها ليس بسبب تغير المآخذ وتحقيق المناط، والله اعلم. Abstract: This study aims to explain the doctrines of scholars and the most correct opinion regarding the ruling on changing a fatwa, To achieve this goal, the researcher presented the evidence for each doctrine, He liberalized the doctrine of Ibn al-Qayyim and al-Shatibi, then followed this with some jurisprudential applications to change the fatwa, He followed the inductive, analytical, comparative approach, collecting the opinions of scholars regarding changing the fatwa, extrapolating the evidence, comparing, analyzing, and preferring, then applying his findings to some issues of jurisprudence. He reached conclusions including: The scholars differed regarding the legality of changing the fatwa based on sects. Some of them believed in prohibiting it, some of them believed in changing its basis, and some of them believed in changing it but without controls. The most of view is that the fatwa is changed but with conditions and controls. It became clear that the most correct opinion is the opinion of the most of scholars, and it became clear to him that the attribution of this opinion to the two imam Ibn al-Qayyim and Al-Shatibi is correct, and that one of the applications of the change in the jurisprudential fatwa is its change in the ruling on women going out to the Masjed's , and its change in the ruling on divorce three times with one pronouncement, It has become clear from the applications that the fatwa changes and that its change is not due to a change in the demands and the achievement of the goal, and God knows best | ||
