| Abstract | ||
| أدى التحول الاقتصادي وتطور حركات الاستثمار إلى ظهور صور متنوعة من العلاقات التعاقدية بين الدولة والمستثمرين التابعين للدول الأخرى، وظهور التحكيم كآلية لفض منازعات العقود الإدارية المرتبطة بالاستثمار كعقود الامتياز، الأمر الذي يتعين معه معرفة مدي تأثر قواعد القانون الإداري بخروج منازعات بعض العقود الإدارية المرتبطة بالاستثمار من اختصاص القاضي الإداري بمجلس الدولة واللجوء فيها الي التحكيم في إطار المركز الدولي لتسوية منازعات الاستثمار ICSID. تهدف هذه الورقة البحث الي إلقاء الضوء على مستقبل قواعد القانون الإداري أمام المركز الدولي لتسوية منازعات الاستثمار ICSID في منازعات العقود الإدارية المرتبطة بالاستثمار، والبحث عما إذا كان من الممكن القول بأن التحكيم يعد خطوة نحو عولمة قواعد القانون الإداري وقضاياه ونشأة ما يسمي بالقانون الإداري الدولي كفرع من فروع القانون الإداري. باستخدام المنهجية التحليلية المقارنة يتم دراسة موقف كل من فرنسا ومصر من اللجوء الي التحكيم في منازعات العقود الإدارية، وكذلك موقف المركز الدولي لتسوية منازعات الاستثمار ICSID من منازعات العقود الإدارية المرتبطة بالاستثمار، وكيفية تناوله لقواعد وأحكام وقضايا القانون الإداري حيال تلك المنازعات. Abstract: The economic transformation and development of investment movements led to the rise of various forms of contractual relations between the state and investors of other countries, and the appearance of arbitration as a mechanism for resolving disputes in administrative contracts related to investment, such as concession contracts. This requires knowing the extent to which the rules of administrative law are affected by the exit of certain administrative contracts related to investment from the jurisdiction of the administrative judge at the State Council and their resorting to arbitration before the International Centre for Settlement of Investment Disputes (ICSID( This research paper aims to shed light on the future of Administrative Law rules before the International Centre for Settlement of Investment Disputes (ICSID) in the disputes of Administrative Contract related to investment, and to examine whether arbitration can be a step towards the Globalization of the Administrative Law rules and issues, and the formation of a so-called “International Administrative Law” as a branch of Administrative Law. By using the comparative analytical methodology, the position of both France and Egypt on resorting to arbitration in administrative contract disputes will be studied, as well as the position of the International Centre for Settlement of Investment Disputes (ICSID) regarding administrative contract disputes related to investment, and how it treats the rules, provisions, and issues of administrative law concerning those disputes. | ||
