| Abstract | ||
| أكدت الشريعة الغراء على ترسيخ مبدأ الأخوة وحسن الجوار بين الناس، وعدم إلحاق الضرر لبعضهم البعض. فالجار ملتزم بعدم الاضرار بجاره، والمراد بالضرر هنا هو الضرر غير المألوف الذي قد يكون ناتج عن تعسف الجار في استعمال حقه على نحو يلحق فيه ضرر لجاره، أو مخالفة القيود التي رسمها النظام او التنظيمات الخاصة بتنظيم حسن الجوار. ونظراً لاختلاف مصالح الجوار وتأثره بما حوله من نشاطات تجارية وتوسعات معمارية، فقد أوجد ذلك صعوبة بحثية من حيث التنقيب في أغلب الأنظمة واللوائح والأدلة الاسترشادية الصادرة في المملكة العربية السعودية، التي يتوقع أن تتنبه إلى خصوصية الجوار، وتأخذها بعين الاعتبار. ويضاف إلى ذلك أن دارسي حماية الجيران كثيراً ما يجنحون إلى الدراسة الفقهية، ويشيرون إشارات سريعة إلى بعض التنظيمات السعودية العامة ذات الصلة بها. لذا فقد تناولت في هذا البحث بيان مضار الجوار غير المألوفة والمسؤولية عنها، كما تنولت بيان مفهوم حماية الجيران في الشريعة الإسلامية والنظام السعودي؛ حيث يناقش البحث مفهوم حماية الجيران شرعا ونظاما ويتناول الأساس القانوني للمسؤولية عن اضرار الجوار، بالإضافة إلى بيان الفرق بين الضرر المألوف وغير المألوف في النظام السعودي. وأخيرا استعرضت في البحث طرق أو وسائل حماية الجار في الشريعة الإسلامية والنظام السعودي. Sharia law places a strong emphasis on fostering a sense of brotherhood and promoting good neighborliness. It highlights the duty for individuals to abstain from causing harm to one another. In the context of neighbors, this obligation necessitates individuals not to engage in actions that result in undue harm, arising from the abuse of one's rights in a manner that adversely affects their neighbor. This includes violations of the established system or regulations governing good neighborliness. The diverse interests connected with neighborhoods, coupled with their significant impact on commercial activities and architectural developments in their neighborhood, pose a research challenge in comprehensively examining the multitude of laws, regulations, and guidelines established in the Kingdom of Saudi Arabia. These regulations consider the unique dynamics of each neighborhood. Furthermore, researchers focusing on neighbor protection frequently resort to jurisprudential studies, often making brief references to overarching Saudi regulations related to this subject. In this study, I investigate into the explanation of the consequences of unfamiliar neighbors and the corresponding responsibilities associated with them. Additionally, I explore the conceptual framework of protecting neighbors within Islamic law and the Saudi legal system. The research examines the legal aspects of neighbor protection and probes into the underlying principles governing responsibility for damages within neighborhoods. Furthermore, the study differentiates between familiar and unfamiliar damages within the Saudi legal framework. In conclusion, the study observes various methods and mechanisms prescribed for protecting one's neighbor within the frameworks of both Islamic law and the Saudi legal system. | ||
