| Abstract | ||
| انتشرت في الآونة الأخيرة عمليات احتكار الأدوية مما كان له عظيم الأثر على صحة المرضى ، وقد ظهر هذا جليًا مع أزمة وباء فيروس كورونا المستجد (كوفيد 19) الذي لم تخل دولة من دول العالم إلا وعبَر حدودها، وانتشر بين سكانها، وقد نتج عن ذلك وجود أزمة في الأدوية التي من شأنها تقوية المناعة، وكذا المستلزمات الطبية كأجهزة الأوكسجين، وأجهزة التنفس الصناعي؛ بسبب قيام بعض المؤسسات الطبية والأفراد باحتكار تلك الأدوية والأجهزة، والتحكم والمغالاة في أسعارها، مما أدى إلى عجز كثير من المرضى عن الحصول على احتياجاتهم الدوائية. ويهدف البحث إلى بيان مفهوم الدواء ، وأهميته في حياة الفرد والمجتمع ، والموقف الفقهي من عملية احتكار الدواء، ومدى دخول الأدوية والمستلزمات الطبية في دائرة السلع التي نص الفقهاء على تحريم احتكارها، وهل يقتصر تحريم الاحتكار على الأدوية المحلية أم يشملها والأدوية المستوردة من الخارج ؟ وهل يقتصر حكم الاحتكار على الاحتكار التجاري للأدوية أم يتضمن الشركات المنتجة للدواء التي تمتنع عن إنتاج بعض الأدوية أو تقلل من إنتاجها ؟ يجيب البحث عن هذه الأسئلة ، وتوصلت من خلاله إلى أن الأدوية أصبحت ضرورة من ضروريات الحياة ، وأنها تدخل في المادة التي يجري فيها الاحتكار ، وأن هذا يشمل الأدوية المحلية والمستوردة من الخارج ، وكذا يشمل الأدوية المنتجة والتجارية ، وأنه يجب على ولي الأمر التدخل لمواجهة محتكري الأدوية كل بما يتناسب مع صنيعه ، إما بوعظهم ، أو تهديدهم ، أو بفرض عقوبة تعزيرية عليهم ، أو بإجبارهم على بيع الأدوية ، أو بمصادرة الأدوية المحتكرة وطرحها في الصيدليات للتوسعة على المرضى . In recent times, drug monopolies have spread, which has had a great impact on the health of patients. This has become clear with the crisis of the new Corona virus epidemic (Covid 19), which has not left any country in the world without crossing its borders and spreading among its population. This has resulted in the presence of... A crisis in medications that strengthen immunity, as well as medical supplies such as oxygen devices and ventilators; Because some medical institutions and individuals monopolize these medicines and devices, and control and exaggerate their prices, which leads to the inability of many patients to obtain their medication needs. The research aims to explain the concept of medicine, its importance in the life of the individual and society, the jurisprudential position on the process of monopolizing medicine, and the extent to which medicines and medical supplies enter the circle of goods that jurists have stipulated prohibiting monopoly. Is the prohibition of monopoly limited to local medicines or does it include them and medicines imported from abroad? Is the monopoly ruling limited to the commercial monopoly of medicines, or does it include drug producing companies that refrain from producing some medicines or reduce their production? The research answers these questions, then presents the most important methods that jurists have stipulated to eliminate this scourge. Until health and community security is achieved. In this research, I followed the inductive and analytical approach, and through it I concluded that medicines have become one of the necessities of life, and that they are included in the subject matter in which monopoly occurs, and that this includes local and imported medicines from abroad, as well as productive and commercial medicines, and that the guardian must Intervening to confront drug monopolists, each in a way that suits his business, either by admonishing them, threatening them, imposing a discretionary penalty on them, forcing them to sell medicines, or confiscating monopolized medicines and putting them in pharmacies to expand their reach among patients. | ||
