| Abstract | ||
| نصت بعض التوجيهات الأوروبية على منح المستهلك الحق في الرجوع عن العقد المبرم بأي وسيلة من الوسائل الإلكترونية ونظمت أحكامه، وتبعها في ذلك الكثير من التشريعات الوطنية، ومن بين هذه الأحكام تحديد نطاق الحق في الرجوع من حيث العقود، بمعنى أن هذا الحق لا يتقرر في جميع عقود الاستهلاك المبرمة بين المورد والمستهلك، لأسباب ومبررات متعددة قد ترجع إلى طبيعة محل العقد أو إلى انخفاض قيمته، أو لغيره من الأسباب التي تختلف من عقدٍ إلى آخر. وتستهدف أسباب المنع في مجملها حماية حقوق ومصالح المورد بعدم الإضرار به، وتحقيق العدالة العقدية بين المتعاقدين، والحفاظ على استقرار التعاملات التجارية. ولقد توصلت هذه الدراسة إلى جواز ومشروعية الاتفاق على الخروج على النص القانوني والسماح للمستهلك باستعمال الحق في الرجوع عن العقد إن جرى التعاقد على العقود المنصوص على استبعادها أو استثنائها من استعمال هذا الحق، وذلك مقيدٌ بأن يرد نص قانوني يجيز الخروج على هذه الأحكام، وأن المستهلك يمكنه الامتناع - في العقود الواردة على تقديم الخدمات إليه - عن دفع أي مقابل مالي إن تم تنفيذ العقد جزئيًا أو كليًا، عندما يخفق المورد أو يخل بالوفاء بالتزاماته القانونية. بالإضافة إلى أن المستهلك يستطيع الرجوع على المورد بموجب القواعد العامة في العقود المبرمة بشأن البضائع أو السلع إن ثبت أنها معيبة أو غير مطابقة للمواصفات، أو الرجوع عليه بموجب استعمال الحق في الرجوع عن العقد. Abstract: Some European directives have provided for granting the consumer the right to withdraw from the contract concluded by any electronic means and organized its provisions, and a myriad of national legislation has followed in their steps. Among these provisions, the identification of the scope of the right to withdraw from contracts, namely, this right is not provided for in all consumer contracts concluded between the professional and the consumer, due to multiple reasons and justifications based on the nature of the subject matter of the contract, or the impairment of its value, or for other reasons that differ from one contract to another. The reasons for prevention in its entirety aim to protect the rights and interests of the supplier by not harming it, as well as realizing contractual justice between the parties and maintaining the stability of commercial transactions. In this context, the research concluded that it is permissible and legitimate to agree upon non-adherence to the legal text and permit the consumer to use the right to withdraw from the contract, in case of entering into contracts that are excluded or excepted from using this right under law. While this is restricted by having a legal provision that permits non-adherence to these provisions. The consumer can refrain – in contracts relative to providing services to it- from paying any financial amount if the contract is implemented in part or in whole, in case the supplier fails to perform or violates its legal obligations. Furthermore, the consumer may recourse to the supplier under the general terms and conditions set out in the concluded contracts regarding goods or commodities if they are found to be defective or non-conformant to the prescribed specifications, or the right to recourse to it based on using the right to withdraw from the contract. | ||
