| Abstract | ||
| مُنحت الإدارة بما لها من سلطة تقديرية سحب بعض ما تصدره من قرارات إذا كانت هذه القرارات غير مشروعة قانونًا أو كانت قرارات غير ملائمة للمصلحة العامة وحسن سير المرافق العامة، إلا أن هذا الحق الممنوح لجهة الإدارة محدد بحدود وضوابط لممارسته، فإذا تغاضت الإدارة عن سحب القرارات الإدارية غير المشروعة كانت نهايته بواسطة القضاء، حيث يقضي بإلغائه من خلال دعوى الإلغاء. ولعملية سحب القرارات الإدارية أهمية كبيرة في الواقع العملي؛ إذ يُعد السحب أحد وسائل إنهاء القرار الإداري؛ إذ يعطي الإدارة فرصة لتصحيح ما قد تقع فيه من أخطاء، وبالتالي فالسحب وسيلة لاتقاء الطعن على قرارات جهة الإدارة المعيبة أمام القضاء. كما أن لسحب القرارات الإدارية غير المشروعة أهمية كبيرة في تحقيق مبادئ العدالة والإنصاف والمساواة، واستقرار المراكز القانونية وحماية الحقوق المكتسبة للأفراد، وتحقيق مبدأ الأمن القانوني. وتكمن أهمية البحث في الوقوف على دور القضاء الإداري المصري والفرنسي والإماراتي في الحفاظ على استقرار المراكز القانونية للأفراد، عند سحب الإدارة لقراراتها الإدارية. وقد استخدمت في البحث المنهج التحليلي والمقارن. جاء البحث بعنوان: "سحب القرار الإداري وأثره في تعزيز مبدأ الأمن القانوني: في ضوء أحكام القضاء الإداري- دراسة مقارنة"، وتناولته من خلال مقدمة، ومبحثين، وخاتمة. أما المبحث الأول، تناولت فيه: مفهوم سحب القرار الإداري، ومفهوم الأمن القانوني. والمبحث الثاني، فقد ذكرت فيه: أثر سحب القرارات الإدارية غير المشروعة والمشروعة على مبدأ الأمن القانوني، وأثر سحب القرار الإداري في تعزيز الثقة في الإدارة وتجنب الطعن القضائي وأثرهما في تحقيق الأمن القانوني. ثم اختتمت بحثي بما توصلت إليه من نتائج وتوصيات. Abstract: The administration has been granted the discretionary authority to withdraw some of the decisions it issues if these decisions are illegal in law or if they are decisions that are not appropriate for the public interest and the proper functioning of public facilities. However, this right granted to the administration is limited to limits and controls for its exercise. If the administration neglects to withdraw the decisions The illegal administration was ended by the judiciary, which ruled to cancel it through an annulment lawsuit. The process of withdrawing administrative decisions has great importance in practice. Withdrawal is one of the means of ending the administrative decision. It gives the administration an opportunity to correct any mistakes it may make, and therefore withdrawal is a means to avoid challenging the administration’s flawed decisions before the judiciary. Removing illegal administrative decisions is also of great importance in achieving the principles of justice, fairness and equality, stabilizing legal positions, protecting the acquired rights of individuals, and achieving the principle of legal security. The importance of the research lies in identifying the role of the Egyptian, French, and Emirati administrative judiciary in maintaining the stability of the legal positions of individuals, when the administration withdraws its administrative decisions. The research used the analytical and comparative method. The research was entitled: "The withdrawal of the administrative decision and its impact on strengthening the principle of legal security: in light of administrative judiciary rulings - a comparative study," and it was dealt with through an introduction, two sections, and a conclusion. As for the first section, I discussed: the concept of withdrawing an administrative decision, and the concept of legal security. The second section, in which I mentioned: The effect of withdrawing illegal and legitimate administrative decisions on the principle of legal security, and the effect of withdrawing the administrative decision in strengthening confidence in the administration and avoiding judicial appeal, and their effect in achieving legal security. Then I concluded my research with my findings and recommendations. | ||
