| Abstract | ||
| يتناول هذا البحث موضوعاً مهما في حياتنا، يتوجب أن يفقهه المسلم، خاصة أصحاب الاختصاص، ويتعرف على أحكامه كي لا يقع في الحرام، لذا فإن أهمية هذه الدراسة تكمن في إلقاء الضوء على بيان أحكام التمريض من وجهة النظر الإسلامية والقانونية، لاسيما أن التمريض أصبح ضرورة طبية لا يمكن الاستغناء عنها، وأصبح علماً مستقلاً له علماؤه وطلابه، ومن جهة أخرى فالموضوع سينير الطريق أمام أولئك المهتمين بدراسة علم التمريض وممارسته في المجتمع الإسلامي، ذلك أنهم سوف يمارسون هذه المهنة على أسس سليمة، تتوافق مع مقاصد الإسلام وتشريعاته الحكيمة. وقد تناولت هذا البحث من خلال مقدمة ومبحثين ، اشتملت المقدمة على أهمية البحث وأسباب اختياري له وخطة البحث، أما المبحث الثاني فقد اشتمل على مفهوم التمريض، وحكمة، وأهميته، وشروطه، والمبحث الثاني بينت فيه وسائل حماية الدولة للتمريض في ظل الأوبئة العامة، واشتمل على: مفهوم الأوبئة ومسئولية الدولة في التداوي منها، المسؤولية الوقائية للدولة لحماية الممرض من الأوبئة، المسؤولية الوقائية للممرض في القانون الوضعي. ثم في نهاية البحث ذكرت عدد من النتائج قد توصلت إليها ، أسأل الله تعالى التوفيق إلى الصواب، والأجر والثواب، وصّلى الله على سيدنا محمد، وعلى آلة وصحبه وسّلم. This research deals with an important topic in our lives. A Muslim, especially those with specializations, must understand it and become familiar with its provisions so as not to fall into what is forbidden. Therefore, the importance of this study lies in shedding light on the explanation of the provisions of nursing from an Islamic and legal point of view, especially since nursing has become a necessity. Medicine is indispensable, and it has become an independent science with its own scholars and students. On the other hand, the subject will illuminate the way for those interested in studying the science of nursing and its practice in Islamic society, because they will practice this profession on sound foundations, consistent with the purposes of Islam and its wise legislation. I dealt with this research through an introduction and two sections. The introduction included the importance of the research, the reasons for choosing it, and the research plan. The second section included the concept of nursing, its wisdom, importance, and conditions. The second section included the means of state protection for nursing in light of general epidemics, and included : The concept of epidemics and the state’s responsibility to treat them, the preventive responsibility of the state to protect the pathogen from epidemics, the preventive responsibility of the pathogen in positive law. Then, at the end of the research, I mentioned a number of results that I had reached. I ask God Almighty to guide me to the right path, and reward and reward. May God’s blessings and peace be upon our master Muhammad, his family, and his companions. | ||
