| Abstract | ||
| يتناول البحث مسألة من المسائل المهمة في علم أصول الفقه، وهذه المسألة تتعلق بباب التعارض والترجيح بين الأدلة، فالأدلة الشرعية متفاوتة في مراتب القوة، ومن ثم يحتاج المجتهد إلى معرفة درجاتها. وقد تناولت تعريف التعارض عند الأصوليين، ومجاله، وأنواعه، وشروطه، وطرق دفعه، والأحاديث التي يوهم ظاهرها التعارض، وأزيل بالجمع والترجيح. وقد جاء هذا البحث في مقدمة، وأربعة مباحث، وخاتمة، بينت في المقدمة أهمية الموضوع، وخطة البحث، ومنهجي في الدراسة، وجاء المبحث الأول في تعريف التعارض في اللغة والاصطلاح، وشرط التعارض، ومجاله، والمبحث الثاني: في طرق دفع التعارض، وبينت طريقة الجمهور، وطريقة الحنفية، وطريقة المحدثين، والمبحث الثالث: في دفع التعارض بالجمع بين الحديثين، وفيه مطلبان: المطلب الأول: تعريف الجمع وشروطه، والمطلب الثاني: الأحاديث المتعارضة التى جمع بينها، والمبحث الرابع: دفع التعارض بالترجيح، وفيه مطلبان: المطلب الأول: تعريف الترجيح وشروطه، والمطلب الثاني: الأحاديث التى ظاهرها التعارض، وأزيل بالترجيح. وفي الخاتمة: بينت أهم النتائج التي توصلت إليها. The research addresses one of the important issues in the science Principles of jurisprudence. This is a question of incompatibility and weighting. It dealt with the definition of incompatibility in fundamentalists; it's His field, its types and conditions, its payment method. Hadiths whose appearance gives the impression of contradiction are removed it is paid by weighting and summation This research came in an introduction, four investigations and a conclusion, which showed in the introduction the importance of the subject, the research plan and the methodology of the study. The first examined the definition of incompatibility in language and terminology, the requirement of incompatibility and its scope. And the second research: in ways of pushing incompatibility, in the audience, the tap, and the Hadith scholars. Third Research: Pushing incompatibility by combining the two hadiths. And Research IV: Pushing Incompatibility by Weighting. In the conclusion, she outlined her most important findings. | ||
