| Abstract | ||
| فهذه رسالة علمية بعنوان: دعوى وقف تنفيذ القرار الإداري، وقد اشتملت هذه الرسالة على: المقدمة: تناولت فيها أسباب اختيار الموضوع وأهميته، وخطة البحث، والمنهج المتبع فيه، وقسمت الرسالة إلى مبحثين: المبحث الأول: بعنوان ماهية دعوى وقف تنفيذ القرارات الإدارية، وفيه ثلاثة مطالب، المطلب الأول: أركان دعوى وقف تنفيذ القرار الإداري، والمطلب الثاني: شروط وقف تنفيذ القرار الإداري، والمطلب الثالث: القرارات الني يجوز طلب وقف تنفيذها. والمبحث الثاني: مناط ولاية دعوى وقف تنفيذ القرار الإداري، وفيه أربعة مطالب، المطلب الأول: الخصائص التي يتميز بها الحكم بوقف التنفيذ، والمطلب الثاني: حجية الحكم الصادر في دعوى وقف تنفيذ القرار الإداري، والمطلب الثالث: تنفيذ الحكم الصادر بوقف التنفيذ وأثره، والمطلب الرابع: الطعن في الحكم الصادر بوقف تنفيذ القرار الإداري، ثم الخاتمة وتشتمل على أهم النتائج، ومنها: 1-إن نظام وقف التنفيذ يشكل استثناء من القاعدة العامة يتمتع من خلاله القاضي بسلطة تقديرية يستطيع على أثرها أن يصدر حكما مؤقتا، وعلى وجه عاجل بوقف تنفيذ القرار الإداري المطعون فيه، متى ما توافرت أسباب جدية ويخشى أن يترتب على تنفيذ القرار آثارا يصعب تداركها. 2-أن وقف التنفيذ هو طلب يتقدم به ذوي الشأن المضرور من تنفيذ قرار إداري تم الطعن عليه بالإلغاء، يسمح للمحكمة وفق سلطتها التقديرية بإصدار قرار يمنع تنفيذ القرار الإداري المطعون فيه، يترتب عليه تائج يتعذر تداركها. 3- يتمتع الحكم الصادر بوقف التنفيذ بحجية في مواجهة الإدارة والكافة، وهذه الحجية تنتهي بصدور الحكم في دعوى الإلغاء. 4- يعتبر الحكم الصادر في طلب وقف التنفيذ حكما مؤقتا بطبيعته ما دامت الظروف لم تتغير. This is a scientific thesis entitled: The lawsuit to stop the implementation of the administrative decision, and this thesis included: Introduction: It deals with the reasons for choosing the topic and its importance, the research plan, and the method used in it. The thesis is divided into two sections: The first topic: entitled what is the lawsuit to stop the implementation of administrative decisions, and it includes three demands, the first requirement: the pillars of the lawsuit to stop the implementation of the administrative decision, and the second requirement: the conditions for stopping the implementation of the administrative decision, and the third requirement: the decisions that may be requested to stop their implementation. The second topic: the mandate of the lawsuit to stop the implementation of the administrative decision, it includes four demands, the first requirement: the characteristics of the stay of execution judgment, the second requirement: the authority of the judgment issued in the lawsuit to stay the implementation of the administrative decision, the third requirement: the implementation of the judgment issued to stay the execution and its impact, and the fourth requirement: the appeal against the judgment issued to stay the implementation of the administrative decision. Then the conclusion includes the most important results, including: 1-The system of stay of execution constitutes an exception to the general rule through which the judge enjoys a discretionary authority, after which he can issue a temporary ruling, and urgently suspend the implementation of the contested administrative decision, whenever there are serious reasons and it is feared that the implementation of the decision will have consequences that are difficult to remedy. 2-The stay of execution is a request submitted by the aggrieved party to implement an administrative decision that has been challenged by cancellation, allowing the court, according to its discretion, to issue a decision preventing the implementation of the contested administrative decision, which results in irreversible consequences. 3-The judgment issued for the suspension of execution shall be valid vis-à-vis the administration and all, and this argumentation ends with the issuance of the judgment in the annulment lawsuit. 4-The judgment issued in the request for stay of execution shall be considered temporary in nature as long as the circumstances have not changed. | ||
