| Abstract | ||
| قد يختلف بعض البشر عن بعضهم من حيث اكتسابهم لبعض الإعاقات التي تمنعهم من ممارسة حياتهم بشكل طبيعي، فالإعاقة جزء من الطبيعة البشرية ومن التجربة الإنسانية، والأشخاص ذوي الإعاقة هم مجموعة متنوعة تؤثر عليهم عدة عوامل مثل الجنس والعمر والهوية والوضع الاقتصادي، بصورة تنعكس على تجاربهم في الحياة بصورة تؤدي إلى قصور في أداء وظائفهم ونشاطهم اليومي أكثر من غيرهم، مما دعا إلى ضرورة تدخل المجتمع الدولي بشكل عام والمجتمعات الوطنية بشكل خاص لخلق قواعد ونصوص تكون هي الدرع الحامي لاستخدام هؤلاء الأشخاص لحقوقهم دون تمييز على قدم المساواة مع الأشخاص الطبيعيين. وتحول الإعاقات البصرية المصاب عن جمع المعلومات، وخاصة المطبوعة، إلا أن القيود الواردة في قوانين الملكية الفكرية ما زالت تقف في طريق إتاحة الأفكار لهم وتمثل معاهدة مراكش لتيسير الوصول إلى المطبوعات أهم خطوات المجتمع الدولي في تمكين المكفوفين للنفاذ إلى المطبوعات ؛ لتحقيق التوازن بين حقهم في النفاذ للمطبوعات وحق المؤلف للحفاظ على الإبداع . وقدمت الدراسة من خلال فصل تمهيدي وثلاث أبواب استعراض لماهية الأشخاص المعاقين بصريًا وأهم مجهودات المنظمات الدولية لحماية حقوقهم وخاصة العامة كعدم التمييز وحرية التعبير وشغل الوظائف والإطار القانوني للحماية الدولية لهم وأهم التوصيات على المستويات الدولية والإقليمية وبجمهورية مصر العربية. Some people may differ from others in that they acquire some disabilities that prevent them from living their lives normally. Disability is part of human nature and the human experience. People with disabilities are a diverse group affected by several factors, such as gender, age, identity, and economic status, in a way that is reflected in their experiences in life. Life in a way that leads to deficiencies in the performance of their functions and daily activities more than others, which called for the need for the international community in general and national communities in particular to intervene to create rules and texts that would be the protective shield for these people to use their rights without discrimination on an equal basis with natural persons. Visual disabilities prevent the affected person from collecting information, especially printed information, but the restrictions contained in intellectual property laws still stand in the way of making ideas available to them. The Marrakesh Treaty to Facilitate Access to Publications represents the most important steps of the international community in enabling blind people to access publications to achieve a balance between their right to access; for publications and copyright to preserve creativity. The study presented, through an introductory chapter and three sections, a review of the nature of visually impaired persons and the most important efforts of international organizations to protect their rights, especially public ones, such as non-discrimination, freedom of expression, and holding jobs, the legal framework for international protection for them, and the most important recommendations at the international and regional levels and in the Arab Republic of Egypt. | ||
