| Abstract | ||
| هذا البحث متعلق بطرق دلالة الألفاظ على المعاني من حيث الوضوح والخفاء، في منهجي الحنفية والجمهور، وهو من المباحث الأصولية المهمة، واحتوى على تمهيد ومبحثين على النحو التالي: المبحث الأول: واضح الدلالة، وفيه مطالب: المطلب الأول: واضح الدلالة عند الحنفية، والمطلب الثاني: التعارض والترجيح بين أنواع واضح الدلالة، والمطلب الثالث: واضح الدلالة عند الجمهور، والمطلب الرابع: وجوه الاتفاق والاختلاف في واضح الدلالة بين المنهجين. أما المبحث الثاني: غير واضح الدلالة، وفيه مطالب، المطلب الأول: غير واضح الدلالة عند الحنفية، والمطلب الثاني: غير واضح الدلالة عند الجمهور، والمطلب الثالث: وجوه الاتفاق والاختلاف في غير واضح الدلالة بين المنهجين خاتمة وفيها أهم نتائج البحث، ومنها: قسم الحنفية واضح الدلالة إلى أربعة أقسام: الظاهر - النص - المفسر – المحكم، وقسمه الجمهور إلى قسمين: الظاهر والنص، الظاهر والنص عند الجمهور يجمعهما، أما عند الحنفية فالظاهر والنص والمحكم كل مستقل بذاته. والظاهر عند الجمهور يشمل الظاهر والنص عند الحنفية، وأن النص عند الحنفية يقبل التأويل، بينما النص عند الجمهور لا يقبله، وأن النص عند الجمهور يشمل المفسر عند الحنفية. كما أن المتشابه عند الجمهور والحنفية متماثلان. كما قسم الحنفية غير واضح الدلالة إلى أربعة أقسام: الخفي- المشكل – المجمل- المتشابه، بينما انقسم الجمهور في تقسيمه إلى مسلكين: الأول: يقتصر في غير واضح الدلالة على المجمل، ويجعله والمتشابه مترادفان. والثاني: يدخل في غير واضح الدلالة المجمل والمتشابه. كما أن المجمل عند الحنفية يتوقف المراد منه على بيان من المجمل (المتكلم)، بينما المجمل عند الجمهور - أيضاً - يتوقف المراد فيه على بيان من المجمل (المتكلم)، ولكن يظهر في بعض أقسامه نصيب للمجتهد في التأمل والطلب. Praise be to Allah, Lord of the Worlds, peace and blessing be upon the best of his true and faithful creation, and then, this research concerns the means of Semantics on meanings in terms of clarity and invisibility, in the two Madhabs Hanafi and Gumhor, It is one of the important fundamentalism investigations, and contains a preamble and two investigations as follows: The First Investigation: clear semantics, with demands, the first demand: the clear semantics to Hanafi Madhab, The second demand: The Contradiction between the semantics of words and preference between them, The Third demand: clear semantics to Al Gumhor Madhab, The Fourth demand: The points of agreement and the differences in clear semantics between the two Madhabs. The Second Investigation: Unclear semantics, with demands, the first demand: the unclear semantics to Hanafi Madhab, The Second demand: Unclear semantics to Al Gumhor Madhab, The Third demand: The points of agreement and the differences in unclear semantics between the two Madhabs. It has a conclusion and it contains the most important research findings including: Hanafi scholars divided the clear semantics into four sections: The apparent meaning, the text, the interpreter, the arbitrator, Al Gumhor scholars divided it into two sections: The apparent meaning and the text. According to Al Gumhor scholars, the apparent meaning and the text combine them, and while according to the Hanafi scholars, the apparent meaning, the text, the interpreter and the arbitrator are each independent. The apparent meaning according to Al Gumhor includes the apparent meaning and the text according to the Hanafi. The Text according to Hanafi Madhab accepts interpretation, whereas the text according to Al Gumhor Madhab is not. The text according to Al Gumhor Madhab includes the interpreter according to the Hanafi Madhab, likewise, the similar according to Al Gumhor and Hanafi scholars is similar. The Hanafis also divided the unclear meaning into four categories: the hidden - the problematic - the general - the similar, while the public was divided in dividing it into two approaches: The first: in the unclear meaning, it is limited to the general, and makes it and the similar are synonymous. The second: It includes general and similar meanings that are not clear in meaning. Likewise, according to the Hanafi school of thought, what is meant by it depends on a statement from the speaker (the speaker), while according to the majority - also - what is meant by it depends on a statement from the speaker (the speaker), but in some of its sections it appears that the diligent person has a share in contemplation and research | ||
