| Abstract | ||
| إن الحيوان مخلوق له أنواع لا يحيط بها العد ، وهو مخلوق ذو روح ويعيش في أمم كأمم البشر ، وأنه يستشعر الخطر ، و يسعى بدافع الغريزة لحماية حياته . وحياة الحيوان محل عناية الشريعة الإسلامية ، ولا يباح قتله إلا لدفع ضرره اذا ثبت أذاه وضرره على الإنسان . وقد ظهر مؤخراً استخدام الحيوان في الحروب ، وتم اقحامه في خوض غمار المعارك التي تقع بين بني البشر بما يعرض حياته للخطر ، وتتعرض روحه للإزهاق. وللشريعة الإسلامية احكام وضوابط وهي في مجملها تحيط حياة الحيوان بالحرمة ، وتمنع إزهاق روحه بلا سبب . فالشريعة الإسلامية لها السبق في حماية الحيوان أثناء الحروب. فلا يجوز استخدام الحيوان أثناء الحرب استخداماً يعرضه للقتل بدون فائدة . وتظهر الشريعة الإسلامية فيما تتضمنه من احكام تتعلق بالحيوان سبقها في عنايتها بحياة الحيوان وحرمته عن ما قررته القوانيين الوضعية ، بل تعد احكامها الأكثر شمولاًعما قصرت عنه الكثير من القوانين والأنظمة الدولية الحديثة. The animal is a creature with species that cannot be counted. It is a creature with a soul and lives in nations like human nations. It senses danger and seeks, out of instinct, to protect its life. The life of an animal is the subject of Islamic Sharia law, and it is not permissible to kill it except to prevent its harm if it is proven that it causes harm to humans. The use of animals in wars has recently become apparent, and they have been drawn into battles that take place between human beings, thus endangering their lives and exposing their lives to the loss of their souls. Islamic law has provisions and controls, which in general regard the life of an animal as sacred and prohibit the taking of its life without cause. Islamic law takes precedence in protecting animals during wars. It is not permissible to use an animal during war in a way that exposes it to being killed without benefit | ||
