| Abstract | ||
| تعد الحماية الدبلوماسية من الوسائل الدولية التقليدية في حماية المستثمر الأجنبي، وذلك عند تضرره أثناء ممارسته للاستثمار لدى دولة أجنبية مضيفة لاستثماراته، فتحدثت الورقة عن مفهوم الحماية الدبلوماسية، وأنها حق للدولة، كما تناولت الورقة أيضًا شروط ووسائل ممارسة الحماية الدبلوماسية، وكذلك مزايا الحماية الدبلوماسية، ثم بعد ذلك استعرضت الورقة الرؤية الحديثة حول نزاعات الاستثمار، وتحديدًا الحديث عن دور التحكيم الدولي في حل هذه النزاعات، وذلك باستعراض تطور المركز القانوني للمستثمر الأجنبي في القانون الدولي، وعن أنواع التحكيم، وعن طرق اختيار القواعد التي يلجأ إليها المحكمون غالبًا، وأخيرًا اختممت الورقة الحديث بتحليل نظامي الحماية الدبلوماسية والتحكيم في نزاعات الاستثمار وذلك باستعراض أبرز المشكلات التي تواجه كلا النظامين، وعن الدور التكاملي بين الحماية الدبلوماسية والتحكيم في نزاعات الاستثمار Diplomatic protection is one of the traditional international means of protecting foreign investors, when they are harmed while investing in a foreign country hosting their investments. The paper clarifies the concept of diplomatic protection; concluding that diplomatic protection is a right of a State. It also explains the conditions and means of exercising diplomatic protection, as well as the advantages of diplomatic protection system. Then, the paper discusses the modern vision of investment disputes, specifically the role of international arbitration in resolving foreign investment disputes; by demonstrating the development of the legal status of the foreign investor in international law; the types of arbitration; and the methods of choosing arbitration’s rules that arbitrators can resort to. Finally, the paper concludes the discussion analyzing the systems of diplomatic protection and arbitration in investment disputes; by reviewing the most prominent problems encountering both systems; and the complementary role between both systems in foreign investment disputes. | ||
