| Abstract | ||
| يهدف البحث إلى بيان التمايز الواقع بين مصلحات العلوم بصفة عامة, وبين طريقة الأصوليين والمحدثين في قبول الأخبار وردها بصفة خاصة, ذلك التمايز الذي نتج عن الجهل به أو التغافل عنه كثير من الانحرافات في التعامل مع سنة النبي من ناحية, وكذا في التعامل مع القواعد التي وضعها الأصوليون لضبط الاستنباط من نصوص الكتاب والسنة من ناحية أخرى. ولقد جاء البحث في مقدمة وتمهيد ومبحثين وخاتمة, أما التمهيد فكان عن لأهمية دراسة مصطلحات العلوم ودور المصطلح في ضبط مقاصد الكاتبين في العلوم المختلفة, وجاء المبحث الأول مبينا وضابطا للفوارق الجوهرية لمصطلح "الحديث الصحيح" بين المحدثين والأصوليين, وجاء المبحث الثاني في جمع واستقراء الأحاديث التي تكلم فيها المحدثون ضعفا وجرحا وردا وقبلها الأصوليون استدلالا على القواعد الأصولية وتمثيلا واستشهادا بها, وأما الخاتمة ففيها أهم ما توصل إليه البحث من نتائج ومنها : التأكيد على أن طريقة الأصوليين تختلف عن طريقة المحدثين في قبول الأخبار وتصحيحها, وأن العلل التي يعلل بها المحدثون الأحاديث ليست محل وفاق عند الأصوليين, وأن صحة المعنى التي تثبت بموافقة الآيات أو السنن الصحاح أو الإجماعات أو موجبات العقول تغني عن الإسناد عند الأصوليين, وأن تلقي الأمة للحديث بالقبول يغني عن النظر في إسناده عند الأصوليين, وأن الفقهاء لا يعملون بحديث إلا وقد صح عندهم على وجه من الوجوه المتعددة, وأن قواعد المحدثين إنما وضعت للحكم على السنن التي لم يعلم حالها, أما ما دخل في الشريعة باتفاق فلا يحاكم إلى تلك القواعد. The research aims to show the differentiation between the interests of science in general, and the way fundamentalists and modernists in accepting news and responding in particular, that differentiation that resulted from ignorance or neglect of it many deviations in dealing with the Sunnah of the Prophet on the one hand, as well as in dealing with the rules set by the fundamentalists to adjust the deduction from the texts of the Book and the Sunnah on the other hand. The research came in the introduction and preamble and two sections and conclusion, the preamble was about the importance of studying the terms of science and the role of the term in adjusting the purposes of the writers in the various sciences, and the first section came indicating and controlling the fundamental differences of the term "correct talk" between the modernists and fundamentalists, and the second section came in the collection and extrapolation of hadiths in which the modernists spoke weakness and wound and response and accepted by the fundamentalists inference of the fundamentalist rules and representation and citation, As for the conclusion, it contains the most important findings of the research, including: Emphasizing that the method of fundamentalists differs from the way of the modernists in accepting and correcting news, and that the ills that the modernists explain the hadiths are not subject to agreement when the fundamentalists, and that the validity of the meaning that is proven by the approval of the verses or Sunan Sahih or consensus or obligations of the minds dispenses with the attribution when the fundamentalists, And that the nation receives the hadith of acceptance obviates the consideration of its attribution when the fundamentalists, and that the jurists do not work with hadith unless it has been true for them in one of the multiple ways, and that the rules of the modernists were developed to judge the Sunnahs that did not know their condition, but what entered into the Sharia by agreement is not tried to those rules. | ||
