| Abstract | ||
| وثقت هذه الدراسة طريقة أهل العلم في تناول المسألة الشرعية وعنايتهم الخاصة بالدليل واختلافهم في فهمه أو في فهم وجه الدلالة منه، وأبانت صوراً من اختلافهم في نوع الخلاف في المسائل الشرعية وهل هناك أثر حقيقي لذلك الخلاف ، فأوضحت معنى الخلاف وأسبابه وأنواعه ، وجمعت المسائل التي اختلف الأصوليون في نوع الخلاف فيها تحديداً في باب الواجب ، واستعراض أقوالهم وأدلتهم وصولاً إلى الرأي المختار، ومشيراً إلى أن الفقهاء رحمهم الله تعالى رحمة واسعة لم يصلوا إلى مذاهبهم وآرائهم بالتشهي أو أنهم ينصرون رأياً كيفما اتفق وإنما كانوا يستندون على قواعد استنبطوها من كلام الشارع وأنَّ خلافهم في المراد من نصوص الشارع , وتنوع آرائهم كان بناءً على تنوع أنظارهم , وهو سر صلاحية الشريعةالإسلامية لكل زمان ومكان . وفيها إيضاح بأن الخلافات المعنوية عند الأصوليين هي الأصل، والقول بصرف النظر عن البحث في الخلافات الأصولية اللفظية غير سديد فلهذه الخلافات فوائد جليلة يمكن تلمسها في هذا البحث . This study documented the way the scholars deal with Sharia issues and their special attention to the evidence and their difference in understanding it or in understanding the significance of it, and showed pictures of their difference in the type of disagreement in Sharia issues and is there a real impact of that disagreement or not? I explained the meaning of the dispute, its causes and types, and collected the issues that differed fundamentalists in the type of disagreement specifically in the section of duty, and reviewed their statements and evidence up to the chosen opinion, in reference to the jurists, may God have mercy on them, did not reach their doctrines Baltshih, but were based on the rules deduced from the words of the street, and that their disagreement in the intended texts of the street, and the diversity of their opinions was based on the diversity of their eyes, It is the secret of the validity of the Sharia for all times and places. It clarifies that the moral differences of the fundamentalists are the origin, and the statement that regardless of the research in the verbal fundamentalist differences is not valid, these differences have great benefits. | ||
