| Abstract | ||
| يهدف البحث إلى بيان القرائن وأثرها في تعيين وبيان المراد من اللفظ المشترك في النصوص الشرعية، وقمت فيه ببيان المراد من القرائن عند الأصوليين مع شرح التعريف، وذكرت أقسام القرائن باعتباراتها المختلفة، فتنقسم من حيث مصدرها إلى: قرائن شرعية، وقرائن عقلية، وقرائن حسية، قرائن عرفية، وتنقسم من حيث وظيفتها وما قامت به إلى : قرينة مبيِّنةٍ، وقرينة مقوِّيةٍ, وتنقسم من حيث هيئتها أو من حيث المقال أو الحال إلى: قرائن مقالية، وقرائن حالية، وتنقسم من حيث قوة أثرها إلى: قرائن قطعية، وقرائن ظنية، وبينت اعتبار القرائن والاعتماد عليها، وأنها أمر ضروري في فهم النصوص الشرعية، وذكرت دليل اعتبار القرائن والعمل بها من القرآن الكريم والسنة النبوية والإجماع، وتناولت خصائص القرائن وكيفية دلالتها، ثم ذكرت تعريف المشترك وهو: اللفظ الموضوع لحقيقتين مختلفتين أو أكثر وضعا أولا من حيث هما كذلك، ثم تناولت أقسام المشترك، ووقوعه في اللغة والقرآن والسنة، مبينا الخلاف الوارد في ذلك، ومستدلا لما ذكرت، ثم ذكرت حكم المشترك واحتياجه إلى قرينة تعين المراد منه وبدونها يكون اللفظ مجملا لا يتضح له معنى، وبينت أن القرينة المعتبرة في اللفظ المشترك هي التي تبين المراد منه عن طريق المعنى الذي أراده المتكلم من كلامه، ثم ذكرت أحوال القرائن المحتفة باللفظ المشترك، وذكرت بعض الفروع الفقهية التي للقرينة أثر في بيان المراد من اللفظ المشترك فيها، وختمت البحث بأهم النتائج التي توصلت إليها، ومنها: أن القرينة ما يصاحب الدليل فيبين المراد منه أو يقوي دلالته أو ثبوته، قسم الأصوليون القرائن إلى أقسام عدة باعتبارات مختلفة، اعتبر الأصوليون القرائن واعتمدوا عليها في فهم النصوص الشرع، وقع المشترك في اللغة والقرآن الكريم والسنة النبوية، قد يقع الاشتراك في الأسماء، والأفعال، والحروف، الاشتراك خلاف الأصل.، حكم المشترك التوقف حتى يتعين أحد معانيه، لا يستعمل المشترك في أكثر من معنى واحد من معانيه على الراجح.، الحاجة في المشترك قائمة على وجود قرينة تعين المراد منه، ذكرت بعض الفروع والمسائل الفقهية المتضمنة ألفاظا مشتركة، والتي للقرينة أثر في بيان وتعيين المراد منها. The research aims to clarify the clues and their impact on the appointment and statement of what is meant by the common word in the legal texts, and I have a statement of what is meant by the clues when the fundamentalists with an explanation of the definition, and mentioned the sections of the clues with their various considerations, divided in terms of their source into: legal clues, and mental clues, and sensory clues, customary clues, and divided in terms of their function and what they have done to: a clear presumption, and a strengthened presumption, It is divided in terms of its form or in terms of the article or the case into: article evidence, and current evidence, and is divided in terms of the strength of its impact into: conclusive evidence, and presumptive evidence, and showed the consideration of evidence and reliance on it, and that it is necessary in understanding the legal texts, and mentioned the evidence for considering the evidence and working with it from the Holy Qur'an, the Sunnah of the Prophet and consensus, and dealt with the characteristics of the clues and how they are significant. Then I mentioned the definition of the subscriber, which is: the subject word for two different or more facts and put first in terms of they are so, then dealt with the sections of the subscriber, and its occurrence in the language, the Qur'an and the Sunnah, indicating the disagreement contained in that, and inferred from what I mentioned, then mentioned the rule of the subscriber and his need for a presumption that specifies what is meant by it and without it the word is a total that does not have a clear meaning, and showed that the presumption considered in the common word is the one that shows what is meant by the meaning that the speaker wanted from his words, and then mentioned The conditions of the clues celebrated by the common word, and mentioned some branches of jurisprudence that the presumption has an impact on the statement of what is meant by the common word, and concluded the research with the most important findings, including: that the presumption is what accompanies the evidence shows what is meant by it or strengthens its significance or proof, the fundamentalists divided the clues into several sections with different considerations, the fundamentalists considered the clues and relied on them in understanding the texts of Sharia, the common sign in the language, the Holy Quran and the Sunnah of the Prophet, the participation may occur in nouns, verbs, and letters, participation is different Original., the subscriber's rule to stop until one of its meanings has to, the subscriber does not use more than one of its meanings most likely.
