| يتناول البحث مسألة رواية الحديث بالمعنى عند المحدثين والأصوليين في رؤية حديثية أصولية، وهي مما تضيف جديدا في خدمة علم أصول الفقه وعلم الحديث ، إذ أن الأصل في رواية الحديث المتفق عليها هي روايته بلفظه وسياقها وليس بمعناه ، والهدف من الدراسة هو الرغبة في الوقوف على آراء المحدثين والأصوليين في حكم رواية الحديث بالمعنى وبيان المسائل والأحكام التي تترتب على ذلك من معنى وحكم وضوابط وتطبيقات، واتبعنا في دراستنا المناهج الآتية : المنهج الاستقرائي : للنصوص الحديثية والأصولية في موضوع الرواية بالمعنى من الكتب الحديثية ، والمنهج الوصفي: من خلال جمع النصوص الشرعية الحديثية والأصولية الخاصة بمعاني وأحكام وضوابط الرواية بالمعنى، والمنهج المقارن: لعرض آراء المحدثين والأصوليين في حكم رواية الحديث بالمعنى ومعرفة ما يترتب عليها من ضوابط وتطبيقات، وقد خلصنا في الدراسة إلى أهم نتائجه وهي إن رواية حديث رسول الله صلى الله عليه وسلم بالمعنى تجوز : إذا كان الراوي عالما بمعنى الكلام وموضوعه ، ومدلولات خطابها ، وعارفا بأحكام الفقه ، ومميزا لما يحيل المعنى ، والمعنى واضحا غير غامض ، مع ملاحظة - أمرين: أ ـ ألّا يكون الحديث متعبدًا بلفظه . ب ـ وألّا يكون مِنْ جوامع كلمه ﷺ . The research deals with the issue of narrating hadith in the sense of the modernists and fundamentalists in the vision of modern fundamentalism, which adds new in the service of the science of jurisprudence and the science of hadith, and the aim of the study is the desire to stand on the views of modernists and fundamentalists in the rule of novel hadith meaning and statement of issues and provisions that result from the meaning and rule and controls and applications. In our study, we followed the following approaches: The inductive approach to hadith and fundamentalist texts on the subject of the novel in the sense of hadith books, and the descriptive approach: through the collection of hadith and fundamentalist legal texts on the provisions and controls of the novel in meaning, and the comparative approach: to present the views of modernists and fundamentalists on the ruling on narrating hadith in meaning and knowing what the consequences It has controls and applications. The study concluded a set of results, including that the narration of the hadith of the Messenger of Allah (peace and blessings of Allaah be upon him) with the meaning is permissible if the narrator is aware of the meaning of speech and its subject, and the implications of the Prophet's discourse, and is familiar with the provisions of jurisprudence, and distinguished from what transmits the meaning, and the meaning is clear and not ambiguous, noting that the hadith should not be worshiped by its word, and that it should not be one of the mosques of the word of the Prophet (peace and blessings of Allaah be upon him). | ||
