| Abstract | ||
| يهدف هذا البحث إلى بيان حكم أحد أدق جزئيات العلة الشرعية وهي زوالها؛ لأنّ زوال العلة الشرعية مُنْتِجٌ للحكم كما ينتجه الإثبات سواء بسواء، وقد عمدت فيه إلى بحث العلاقة بين رفع الحكم وبقائه عند زوال علته الشرعية التي تعلق بها، مؤكدًا أن تلك العلاقة لا تخرج عن تَعْلِيق الحكم الشرعي المتعلق بالوصف؛ للإعدام الطارئ على الوصف المزال، ومن ثَمَّ يتغير حكمه الذي تعلق به فينقله من التحريم إلى الإباحة، أو العكس؛ ولهذا تبقى الأحكام المزالة بزوال عللها مرهونة بعودة أوصافها، كما تؤكد تلك العلاقة أنه لا يلزم من زوال العلة لزوم زوال الحكم؛ لأنّ ثبوت الحكم أعم من أن يُقْصَر على ثبوته بعلة واحدة؛ إذ قد يكون له أكثر من علة، أو يقوم دليل على اعتباره بعد زوال علته، والمصحح الشرعي والعقلي لهذا الزوال أسباب وشروط وطرق صحيحة لرفع الحكم وتعليقه، وقد أصلت لذلك تأصيلاً أصوليًا، مقربًا بذلك ما استشكل من معاني زوال العلة، موضحًا كل هذا بالأمثلة، مبينًا أثر ذلك في التقعيد الأصولي. This research aims to clarify the rule of one of the most accurate parts of the legal illness, which is its demise, because the demise of the legal illness is a product of the judgment as produced by proof, whether both, and has deliberately discussed the relationship between lifting the judgment and its survival when the disappearance of the legitimate illness that attached to it, stressing that this relationship does not depart from the suspension of the legal ruling related to the description; The removal of the disappearance of its ills is subject to the return of its descriptions, and that relationship confirms that it is not necessary from the disappearance of the cause for the necessity of the demise of the judgment, because the proof of the judgment is more general than being limited to proving it with one fault, as it may have more than one fault, or there is evidence that it is considered after the demise of its illness, and the legal and mental corrector of this demise reasons, conditions and correct ways to raise and suspend the judgment, and it has established a fundamental rooting for that, thus bringing closer to the meanings formed The demise of the cause, explaining all this with examples, showing the impact of this on the fundamentalist repetition. | ||
