| Abstract | ||
| يهدف هذا البحث إلى بيان أهمية ضرب الأمثال في السنة المطهرة، وعلاقته بعلم أصول الفقه، من خلال الكشف عن مدى ارتباطه وعلاقته ببعض القواعد والأدلة الأصولية، وتأثير ذلك في استنباط الأحكام منه، واستخراج الفروع عليه، في ظل الوقوف على آراء العلماء في هذا الاستنباط، وتوثيق ذلك بنماذج من السنة النبوية الشريفة، تمثل الأحكام الشرعية بشقيها التكليفية والوضعية. وكان من أهم النتائج التي توصل إليها البحث: أن للأمثال النبوية أهمية كبيرة في استنباط الأحكام، وإيضاح المقاصد في الشريعة الإسلامية، وبالوقوف عليها وإدراكها جَمْع بين الرؤية الأصولية الفقهية والنظرة المقاصدية؛ فهي ذات علاقة وثيقة بعلم أصول الفقه؛ إذ بالإضافة إلى انتمائها إلى المصدر الثاني للتشريع، وكونها أحد الأدلة المتفق على حجيتها، تعد نوعًا من القياس، وقد استند إليها الأصوليون في احتجاجهم على العمل به، وتُعتبر أحد أنواع دلالة الإيماء، إحدى الطرق الدالة على العلية، ولها صلة قوية بدلالة السياق، وأنواع البيان، وأسباب الترجيح بين الأدلة، ولا خلاف بين العلماء في استنباط الأحكام من أحاديث ضرب الأمثال، التي قصد الشارع بها بيان الحكم، وإنما النزاع في أحاديث الأمثال التي سيقت لمقاصد أخرى، ويمكن أن يستدل من ظاهرها على الأحكام. ويوصي البحث بالاهتمام بالأمثال النبوية جمعًا، وتحليلًا، ودراسة؛ للاستفادة منها في المناهج التربوية، والتعليمية، والدعوية، وضرورة التأسي بالأسلوب النبوي الحكيم، بما فيه من الحلم والرفق واللين؛ لما يترتب عليه من سرعة الاستجابة، وقوة التأثير. This research aims to show the importance of proverbs, and its relationship to the science of jurisprudence, by revealing the extent of its association and its relationship to some rules and fundamentalist evidence, and the impact of this in deducing the provisions from it, and extracting branches on it, in light of standing on the opinions of scholars in this deduction, and documenting it with models from the Sunnah of the Prophet, representing the legal provisions in both commissioning and status. One of the most important results of the research: that the multiplication of proverbs is closely related to the science of jurisprudence, and of great importance in deriving provisions and clarifying the purposes in Islamic law, and this has been confirmed through the application of the Prophet's proverbs, by realizing and standing on them combined the vision of the fundamentalist jurisprudence and the intentional view, as in addition to belonging to the second source of legislation, and being one of the evidence agreed on its authenticity, is a kind of measurement, and the fundamentalists have relied on itIn their protest against the work of it, and is considered one of the types of indication of gesture, one of the ways indicative of the attic, as the research proved that the multiplication of proverbs strong link in terms of context, types of statement, and reasons for weighting between evidence, and no disagreement between scientists in the deduction of provisions of proverbs that were intended to hit the statement of judgment, but the conflict in the proverbs that were given for other purposes, and can be inferred from the apparent provisions. The research recommends paying attention to legal proverbs collecting, analyzing, and studying them to benefit from them in the educational, educational, and advocacy curricula, and the need to establish the wise prophetic method, including dreaming, kindness and softness, because of the consequent speed of response and the power of influence. | ||
