| Abstract | ||
| من الأدلة التي تداولتها كتب الأصول –قديمًا- عمل أهل مكة، إلا أن هذه الكتب تناولته على استحياء، ولم تُطِلْ النظر أو البحث فيه؛ ظانين أن لم يُولَ اهتمامًا من السادة الفقهاء الأربعة وغيرهم، ولكن الواقع الشاهد غير ذلك، فإن الإمام الشافعي المطلبي المكي قد أولاه اهتمامًا بالأخذ به في كثير من فقهه. ومن ثم كان لِزِامًا أن نبرز هذا الدليل ونُعِدُّهُ للبحث والمناقشة، وقد حاولت من خلاله إبراز حجية عمل أهل مكة، ومدى جواز تقليدهم، مع بعض تطبيقات الفقه المكي. ومن أشهر من عَمِلَ بعمل أهل مكة الإمام الشافعي –رحمه الله-، حيث بها نشأ وتعلم العلوم من العربية إلى الحديث إلى الفقه، يقول أبو الوليد المكي الفقيه موسى بن أبي الجارود: "كنا نتحدث نحن وأصحابنا من أهل مكة أن الشافعي أخذ كتب ابن جريج عن أربعة أنفس: عن مسلم بن خالد، وسعيد بن سالم، وهذان فقيهان، وعن عبد المجيد بن عبد العزيز بن أبي رواد، وكان أعلمهم بابن جريج، وعن عبد الله بن الحرث المخزومي، وكان من الأثبات، وأطلق عليه أهلوها "ناصر الحديث"، ومن خلال هذه الدراسة سنبين هذا. وقد اتبعت في هذا البحث منهجية استقرائية، ثم تحليلية، ثم استنباطية. ثم خَلُصَ البحث إلى عدة نتائج وتوصيات، وأهم توصياته: النظر في إجماع أهل الحرمين –مكة والمدينة-، وخاصة بعد بيان أن لأهل مكة عمل وعرف متبع عند الإمام الشافعي –رحمه الله-، وأن لأهل المدينة عمل مأخوذ به ومقدم على خبر الآحاد عند الإمام مالك –رحمه الله-. One of the evidence circulated in the books of assets - in the past - the work of the people of Mecca, but these books dealt with it timidly, and did not look at or research it, thinking that did not pay attention to the four jurists and others, but the witness reality is otherwise, the Imam Shafi'i Muttalib Meccan has paid him attention to take it in many of his jurisprudence, and then it was necessary to highlight this evidence and prepare it for research and discussion, and I have tried through it to highlight the authenticity of the work of the people of Mecca, and the extent to which it is permissible to imitate them, With some applications of Meccan jurisprudence, and the most famous of the work of the people of Mecca Imam Shafi'i - may God have mercy on him -, where he grew up and learned science from Arabic to talk to jurisprudence, has followed in this research methodology inductive, then analytical, then deductive, then concluded the research to several results and recommendations, and the most important recommendations: Consider the consensus of the people of the Two Holy Mosques - Mecca and Medina -, especially after the statement that the people of Mecca work and custom followed when Imam al-Shaafa'i (may Allah have mercy on him) and that the people of Madinah have a work that is taken and presented on the news of Sundays according to Imam Malik (may Allah have mercy on him). | ||
