| Abstract | ||
| بيان معنى فتح الذرائع، فقد يتوهم البعض أن المقصود بفتح الذرائع هو إباحة الذرائع التي سدت لكونها تؤدي إلى الحرام، وهذا ما يرفضه أصحاب الفطرة السليمة، فأردت التوضيح أن المراد هو فتح الذرائع التي تؤدي إلى الواجب والمندوب والمباح، أو فتح الذرائع في كل أمر اجتمعت فيه مصلحة ومفسدة وكانت المصلحة أرجح، أو دعت الضرورة إلى وجوب هذا الفعل عملا بقاعدة «الضرورات تبيح المحظورات». ومصطلح فتح الذرائع وإن لم يحظ بنصيب من الشهرة في كتب الأصول كمصطلح سد الذرائع إلا أنه مسطر في الكتب العتيقة، أما من لم ينص على مصطلح فتح الذرائع من العلماء فقد نص على معناه في قواعدهم، وقد قمت بتقسيم البحث إلى مقدمة وأربعة مباحث، وخاتمة، أما المقدمة فتشتمل على أهمية الموضوع وسبب اختياره وخطة البحث، أما المبحث الأول: فجعلته في تعريف فتح الذرائع والألفاظ ذات الصلة، أما المبحث الثاني: فجعلته في أقسام فتح الذرائع وضوابطها، والمبحث الثالث: جعلته في بيان مذاهب الأصوليين في حجية فتح الذرائع، والمبحث الرابع: جعلته في نماذج من التطبيقات الفقهية التي أخذ فيها الفقهاء بمبدأ فتح الذرائع، أما الخاتمة: فقد بينت فيها أهم النتائج والتوصيات التي توصلت إليها من خلال هذا البحث. Explaining the meaning of opening excuses, some may fancy that what is meant by opening excuses is the permissibility of pretexts that have blocked because they lead to the forbidden, and this is what the owners of common sense reject, so I wanted to clarify that what is meant is to open pretexts that lead to duty, delegate and permissible, or open pretexts in every matter in which the interest and spoiler met and the interest was more likely, or the necessity arose to the necessity of this act pursuant to the rule of «necessities allow prohibitions». The term open excuses, although it did not have a share of fame in the books of assets as the term dam excuses, but it is underlined in the old books, but who did not stipulate the term open excuses of scientists has stipulated its meaning in their rules, and I have divided the research into an introduction, a preamble, three sections, and a conclusion, while the introduction includes the importance of the subject and the reason for choosing it and the research plan, the introduction: So I made it in the definition of opening excuses and explaining their importance, The first section: made it in the sections of opening excuses and controls, and the second section: made it in the statement of the views of fundamentalists in the authority of opening excuses, and the third section: made it in models of jurisprudential applications in which jurists took the principle of opening excuses, the conclusion: it showed the most important results and recommendations reached through this research. | ||
