| Abstract | ||
| موضوع الزكاة يشغل بال أصحاب الأموال من المسلمين وبالأخص من عنده أموال كثيرة سواء أبلغت النصاب -على لغة الفقهاء- أم لم تبلغ، وهناك أسئلة كثيرة تدور حول نقطة واحدة وهي: عندي أوراق نقدية -فلوس بلغة العامة- وهذه الأموال قد بلغت النصاب، غير أني أعطيتها لتاجر -مضاربة- يتاجر فيها والربح الذي يأتيني من هذه التجارة قد يكون شهريًا وقد يكون سنويًا غير أني أصرفه كله في متطلبات أسرتي، ولا أضيف منه شيئًا إلى رأس المال، بل آخذه كله ليساعدني على مصاريف البيت مع راتبي، وإني مع ذلك قد يصل بي الحال في أغلب الشهور لا أجد ما يكفيني. والسؤال الأول: هل عليّ زكاة في رأس هذا المال، علمًا بأن راتبي وما يأتيني من ربح المضاربة لا يكفيني، وإذا وجبت عليّ الزكاة ربما اقترضت أو أخذت من رأس المال وبالتالي ينقص الربح الذي يأتي من المضاربة فتضيق الحياة أكثر؟. والسؤال الثاني: هل أستحق أخذ الزكاة والحال كما وصفت أم لا؟ وقد جاء البحث في مقدمة، وأربعة مباحث، وخاتمة, تناولت في المقدمة أهمية الموضوع، وأهم أسباب اختياري له، وتساؤلات البحث، ومنهجه. وذكرت في المبحث الأول: مقدمات تمهيدية للبحث. وفي المبحث الثاني ذكرت موقف الفقه الإسلامي من اشتراط كون المال فاضلًا عن الحاجة الأصلية لوجوب الزكاة فيه. وتحدث في المبحث الثالث: عن موقف الفقه الإسلامي من حقيقة الغنى. وبينت في المبحث الرابع: موقف الفقه الإسلامي من حقيقة الفقير والمسكين. أما الخاتمة فذكرت فيها أهم النتائج ومنها: أن الزكاة تجب في النقدين -الذهب والفضة- وما يقوم مقامهما من النقود الورقية، متى بلغا النصاب وتحققت باقي الشروط من: النماء، وحولان الحول، وتمام الملك وكماله, وأن كل ما يُتخذ للاستعمال الشخصي لا زكاة فيه وإن كثر، كالسيارة، والمنزل، وآلات الحرفة, وأن من شروط وجوب الزكاة: كون المال فاضلًا عن حاجة صاحبه الأصلية، على المختار، وضابط الحاجة الأصلية هو: ادخار مقدار النصاب، أو استثماره دون الحاجة إليه أو إلى أرباحه مدة الحول. The issue of zakat concerns the owners of money from Muslims, especially those who have a lot of money, whether I reached the nisab - according to the language of jurists - or not, and there are many questions revolving around one point, which is: I have banknotes - money in the language of the public - and these funds have reached the nisab, but I gave them to a trader - speculation - who trades in them and the profit that comes to me from this trade may be monthly and may be annual, but I spend it all in the requirements of my family, and I do not add anything from it to the capital, but I take it all to help me with the expenses of the house with my salary, and I may still end up in most months not finding enough for me. The first question is: Do I have to pay zakaah on the capital of this capital, knowing that my salary and the profit that comes to me from the speculation are not enough for me, and if zakat is obligatory on me, I may borrow or take from the capital, and thus the profit that comes from speculation decreases and life becomes narrower even more? The second question is: Do I deserve to receive zakat and the situation as described or not? The research came in an introduction, four sections, and a conclusion, which dealt with the importance of the topic, the most important reasons for choosing it, the research questions, and its methodology. I mentioned in the first section: introductory introductions to the research. In the second section, I mentioned the position of Islamic jurisprudence on the requirement that money be virtuous for the original need for zakat in it. He spoke in the third section: about the position of Islamic jurisprudence on the reality of wealth. And showed in the fourth section: the position of Islamic jurisprudence of the reality of the poor and needy. As for the conclusion, it mentioned the most important results, including: that zakat is due in the two coins - gold and silver - and what takes their place of paper money, when they reach the nisab and the rest of the conditions are achieved from: growth, and around the year, and the perfection of the king and its perfection, and that everything taken for personal use is not zakat, even if it is many, such as the car, the house, and craft machines, and that one of the conditions for the obligation of zakat: The fact that the money is virtuous from the original need of its owner, on the chosen one, and the officer of the original need is : Saving the amount of nisab, or investing it without the need for it or its profits for the duration of the year. | ||
