| Abstract | ||
| حاولت في هذا البحث كشف النقاب والإسفار عن قضية هي من أخطر القضايا التي قد يتعرض لها الفرد في نفسه أو محيطه ومجتمعه؛ ألا وهي قضية: «الأمية الفقهية» وذلك ببيان ماهيتها، ومدى خطورتها، وبعرض أظهر مظاهرها وأوضح صورها، وعوامل انتشارها، وطرق علاجها أو الحد منها، وقد تبين من خلال البحث، أن من أظهر مظاهر الأمية الفقهية: الوقوفَ على ظاهر النص الشرعي مع استحالته، أو تعذره، أو وجود ما يصرفه عن ظاهره، أو التهاونَ في التعامل مع النص الشرعي أو الفقهي بالاعتداء عليه واغتياله، بتعطيله، أو تأويله تأويلا يُخرجه عن سياقه أو سباقه أو لِحاقه، أو بِلَيِّ عُنُقِه، ومن مظاهرها أيضا: التشدد في بيان الحكم الفقهي، أو الوقوف مع الشاذ من الأقوال دائما، وأن من عوامل انتشارها: التقليدَ، والتعصبَ للمذهبية، أو التَّنصُّلِ منها، ثم أوضحتُ لكل مظهر طريقا يعالجه أو على الأقل يحد منه، وذلك بإلزامية التفقيه والفقه الصحيح للنصوص، ووسطية تطبيقه، وإزالة العداء مع الفقهاء والمذاهب الفقهية، وكيفية استثمار الاختلاف الفقهي بما يوائم ويلائم الأصل دون انفصال عن العصر. I tried in this research to unveil and travel on an issue that is one of the most serious issues that the individual may be exposed to in himself or his surroundings and society, namely the issue: the stumbles of those working with the fatwa by indicating what they are, and the extent of their danger, and by presenting their manifestations and the clearest images, and the factors of their spread, and ways to treat or reduce them, and it was found through research, that who showed the manifestations of the stumbling blocks of those working with the fatwa: Standing on the appearance of the legal text with its impossibility, or its excuse, or the existence of what distracts it from its appearance, or negligence in dealing with the legal or jurisprudential text by attacking and assassinating it, by disrupting it, or interpreting it in a way that takes it out of context, racing or catching it, or twisting its neck, and its manifestations also include: Strictness in the statement of jurisprudential ruling, or standing with the abnormal of the sayings always, and that the factors for their spread include: Imitation, fanaticism or repudiation of sectarianism, and then explained to each appearance A way that addresses it or at least limits it, by obligatory jurisprudence and correct jurisprudence of texts, moderation of its application, removal of hostility with jurists and schools of jurisprudence, and how to invest jurisprudential difference in a way that suits and suits the original without separation from the era. | ||
