| Abstract | ||
| يهدف هذا البحث إلى التأصيل القانوني للاتفاقيات الإطارية التي تبرمها الجهات العامة، واستعراض كل ما يتعلق بها من أحكام قانونية، بالإضافة إلى الوقوف على الضمانات القانونية لحرية المنافسة عند إبرام الاتفاقيات الإطارية العامة. وقد اتبعت المنهج التأصيلي، والتحليلي، والنقدي؛ وتوصلت من خلال هذا البحث إلى مجموعة من النتائج أوجزها في أن الاتفاقيات الإطارية العامة تعتبر عقوداً تبرمها جهة حكومية أو أكثر، مع واحد أو أكثر ممن تم اختيارهم بأحد الطرق أو الأساليب المحددة قانوناً، بحيث تتضمن وضع النظام الأساسي لما يتم إبرامه خلال فترة زمنية محددة من عقود لاحقة، سواء كان العقد الإطاري مغلقاً يقتصر على من تم اختياره عند بداية الطرح، أو كان مفتوحاً يسمح بانضمام آخرين طوال فترة الاتفاق. وتحقق الاتفاقيات الإطارية التي تبرمها الجهات الحكومية في ظل القانون رقم 182 لسنة 2018م مزايا عديدة منها: توفير الوقت والجهد، وتيسير إبرام عقود التطبيق التي تبرم في إطار الاتفاقية الإطارية، وتجنب المنازعات مستقبلاً، وتحقيق كفاءة وفاعلية الإنفاق العام، وتوحيد مستويات الجودة والأسعار، كما تتمتع الاتفاقيات الإطارية العامة بأهمية كبيرة في العقود التي يزيد فيها التعويل على الاعتبار الشخصي؛ بالإضافة إلى أهمية الاتفاقيات الإطارية للقطاع الخاص، حيث يتمكن من أبرمت معه الاتفاقية الإطارية من الحصول على أكبر حصة سوقية، والوصول إلى العديد من الجهات الحكومية. ولذلك تتمتع الجهات الإدارية بسلطة تقديرية واسعة في إبرام الاتفاقيات الإطارية؛ وعلى الرغم من مزايا إبرام الاتفاقيات الإطارية إلا أنها تعتريها بعض المخاطر، حيث تؤثر الاتفاقيات الإطارية على مقومات حرية المنافسة، لما قد يترتب على إبرامها من استحواذ من وقع عليه الاختيار على سلسلة التعاقدات التي ستتم طوال فترة الاتفاقية الإطارية؛ ولذلك فقد تضمن القانون رقم (182) لسنة 2018م ولائحته التنفيذية عدداً من التدابير التي يمكن أن تحافظ على حرية المنافسة في حال إبرام الاتفاقيات الإطارية؛ كما انتهى الباحث إلى عدد من التوصيات والتي من أهمها التوسع في نمط الاتفاقيات الإطارية المفتوحة، وتقليص نمط الاتفاقيات الإطارية المغلقة، بالإضافة إلى اقتراح بعض التعديلات على التنظيم القانوني للاتفاقيات الإطارية بهدف تعزيز مبدأ حرية المنافسة. This research aims at the legal rooting of framework agreements concluded by public authorities, and to review all related legal provisions, in addition to identifying legal guarantees for freedom of competition when concluding general framework agreements. Through this research, I have reached a set of results, summarized in that general framework agreements are considered contracts concluded by one or more government agencies, with one or more of those who have been selected by one or more of those selected by one of the legally specified methods or methods, so that they include the development of the statute for what is concluded during a specific period of time from subsequent contracts, whether the framework contract is closed and limited to those who were selected at the beginning of the offering, or it is open that allows the accession of others. throughout the period of the agreement. The framework agreements concluded by government agencies under Law No. 182 of 2018 achieve advantages There are many of them: saving time and effort, facilitating the conclusion of implementation contracts concluded within the framework agreement, avoiding future disputes, achieving efficiency and effectiveness of public spending, and standardizing quality and price levels, and general framework agreements are of great importance in contracts in which reliance on personal consideration increases, in addition to the importance of framework agreements for the private sector, where those with whom the framework agreement is concluded can obtain the largest market share, and access to many government agencies. Therefore, the administrative authorities have wide discretion in concluding framework agreements, and despite the advantages of concluding framework agreements, they are fraught with some risks, as framework agreements affect the elements of freedom of competition, as their conclusion may result in the acquisition of the selected person on the series of contracts that will take place throughout the period of the framework agreement, and therefore Law No. (182) of 2018 and its executive regulations included a number of measures that can preserve freedom of competition in the event of the conclusion of agreements.
