يتناول هذا البحث حماية حقوق المشتري في البيع على الخارطة في المملكة العربية السعودية، مع التركيز على النظام الذي وضعه المنظم السعودي لضمان تنفيذ المطور العقاري لالتزاماته التعاقدية، يأتي هذا النظام في إطار النهضة الاقتصادية وتحقيق رؤية المملكة 2030م، مما يشكل دعامة أساسية للتطوير العقاري ويوفر الحماية للمشترين من خلال إجراءات وشروط محددة، يجب على المطور الالتزام بها قبل وأثناء عملية البيع.
والبحث يسلط الضوء على أهمية التعاقد على الخارطة، كضرورة في مجال التطوير العقاري، ويهدف إلى استعراض فعالية النظام القائم ومدى قدرته على حماية المشتري، كما يتطرق إلى الحماية الإجرائية والجنائية التي يوفرها النظام للمشترين ويعالج التساؤلات حول جواز البيع على الخارطة والضمانات اللازمة لحماية حقوق المشتري.
ويعتمد البحث على المنهج الوصفي التحليلي لدراسة نصوص النظام وتقييم فعاليتها في تحقيق الحماية المنشودة للمشتري، ومن خلال هذا البحث، استخلص الباحث عدة نتائج، تبين أن النظام السعودي قد أوجد بيئة قانونية تحمي حقوق المشتري عبر عدة آليات، منها إجبار المطور على الخضوع لمراحل إجرائية محددة، وإنشاء حساب بنكي خاص بالمشروع لضمان حقوق المشترين.
وفي ختام البحث، قدم الباحث مجموعة من التوصيات لتعزيز حماية المشتري، منها تحديد تعريف واضح لعقد البيع على الخارطة، وضرورة إلزام المطور بنقل الملكية للمشتري بمجرد سداد كامل الثمن، كما يوصي بتجريم بعض الأفعال التي قد يقوم بها المطور، وتعويض المشترين عند التأخير في تسليم الوحدات العقارية أو عدم نقل الملكية.
Abstract:
This research deals with the protection of the buyer's rights to off-plan sale in the Kingdom of Saudi Arabia, with a focus on the system developed by the Saudi regulator to ensure that the real estate developer implements his contractual obligations, this system comes within the framework of the economic renaissance and the achievement of the Kingdom's Vision 2030, which constitutes a basic pillar of real estate development and provides protection for buyers through specific procedures and conditions, which the developer must adhere to before and during the sale process.
The research highlights the importance of off-plan contracting as a necessity in the field of real estate development, and aims to review the effectiveness of the existing system and its ability to protect the buyer, as well as the procedural and criminal protection provided by the system to buyers and addresses questions about the permissibility of off-plan sale and the necessary guarantees to protect the buyer's rights. The research relies on the descriptive analytical approach to study the texts of the system and evaluate their effectiveness in achieving the desired protection for the buyer, and through this research, the researcher concluded several results, showing that the Saudi system has created a legal environment that protects the rights of the buyer through several mechanisms, including forcing the developer to undergo specific procedural stages, and establishing a bank account for the project to ensure the rights of buyers.
At the end of the research, the researcher made a set of recommendations to enhance the protection of the buyer, including defining a clear definition of the off-plan sale contract, and the need to oblige the developer to transfer ownership to the buyer as soon as the full price is paid, and recommends criminalizing some acts that the developer may perform, and compensating buyers when delaying the delivery of real estate units or not transferring ownership. |
