Abstract
يناقش هذا البحث سلطة القاضي الإداري في الحد من اشكاليات عدم تنفيذ السندات التنفيذية لصالح الجهات الإدارية أو ضدها، وقد تم استخدام المنهجي التحليلي والوصفي لتحليل ودراسة كافة النصوص المتعلقة بالموضوع، وبيان مدى توافقها مع سلطة القاضي بعملية التنفيذ.
وقد خلصت الدراسة إلى أهمية نظام التنفيذ أمام ديون المظالم لحمل الجهات الإدارية على احترام التنفيذ، لكون القضاء الإداري حامى الحقوق والحريات العامة من عسف الجهات الإدارية.
وقد ابرزت الدراسة جملة من النتائج أهمها: أن التنفيذ الاختياري هو الأصل، ولا يتم اللجوء إلى التنفيذ الجبري إلا بعد المطالبة من الدائن للمدين بأداء الحق, وضرورة تعزيز دور القاضي بعملية التنفيذ من خلال منحه الصلاحيات ومرونة الإجراءات القضائية اللازمة لإجبار المنفذ ضده على التنفيذ.
 
Abstract:
This research discusses the authority of the administrative judge in reducing the problems of non-implementation of executive bonds in favor of the administrative authorities or against them, and the analytical and descriptive methodology has been used to analyze and study all texts related to the subject, and to indicate their compatibility with the authority of the judge in the implementation process.
The study concluded the importance of the implementation system in front of grievance debts to get the administrative authorities to respect the implementation, because the administrative judiciary protects public rights and freedoms from the arbitrariness of the administrative authorities.
The study highlighted a number of results, the most important of which are: that voluntary execution is the original, and forced execution is resorted to only after the creditor demands the debtor to perform the right, and the need to strengthen the role of the judge in the implementation process by granting him the powers and flexibility of judicial procedures necessary to force the executor against him to implement.
