| Abstract | ||
| يتناول هذا البحث: الأحكام الفقهية التي راعت مقصد الترغيب في الإسلام، وإن من مقاصد الشريعة الإسلامية الترغيب في الإسلام، والناظر في كثيرٍ من الأدلة الشرعية، والأحكام الفقهية يلحظ فيها تشوف الشارع إلى ترغيب الناس في الدخول إلى هذا الدين، ودفع كل ما قد يؤول إلى التنفير والخروج عنه؛ لذلك عني الفقهاء -رحمهم الله - بالمقاصد في تقرير أحكامهم، وخصوصًا مقصد الترغيب في الإسلام، مع مراعاة ضوابط توظيف هذا المقصد وحدوده، وما تلك العناية إلا دليل على أهمية علم مقاصد الشريعة في علم الفقه، فمتى انفكت المقاصد عن الأحكام في الاجتهاد الفقهي، تاهت الأحكام وضمرت، وأضحت صورًا جامدة لا حراك فيها، وقد خص البحث مجموعة من المسائل منها: مشروعية ترك الأفضل ترغيبًا في الإسلام، وإسقاط قضاء العبادات عن الكافر إذا أسلم، وإعطاء المؤلفة قلوبهم من الزكاة، ومشروعية الصلح، وإسقاط العقوبات والضمانات عن الكافر بعد إسلامه، وتمليك المحارب ما غنمه من أموال المسلمين إذا أسلم، والعدل وحسن الخلق مع الكفار. ويهدف البحث إلى: بيان مكانة مقصد الترغيب في الإسلام في الشريعة الإسلامية، وجمع بعض الأحكام الفقهية المتأثرة بمقصد الترغيب في الإسلام، وإبراز مدى تأثير مقصد الترغيب في الإسلام في الأحكام الفقهية This research deals with: the jurisprudential rulings that took into account the goal of encouraging people to embrace Islam, and one of the goals of Islamic law is to encourage people to embrace Islam, and one who examines many of the legal evidences and jurisprudential rulings notices in them the legislator’s desire to encourage people to enter this religion, and to repel everything that might lead to... Alienation and departure from it; Therefore, the jurists - may God have mercy on them - paid attention to the objectives in determining their rulings, especially the objective of encouraging Islam, taking into account the controls and limits of employing this objective. This attention is only evidence of the importance of knowing the objectives of Sharia in the science of jurisprudence. When the objectives are separated from the rulings in jurisprudential jurisprudence, they are lost. The rulings were atrophied and became static images with no movement in them. The research focused on a group of issues, including: the legality of abandoning what is best in order to encourage Islam, waiving the fulfillment of acts of worship from an infidel if he converts to Islam, giving zakat to those whose hearts are reconciled, the legality of reconciliation, and waiving penalties and guarantees from the infidel after he converts to Islam. And the warrior’s ownership of what he seized from the Muslims’ money if he converted to Islam, and justice and good behavior with the infidels. The research aims to: clarify the status of the purpose of enticing Islam in Islamic law, collect some jurisprudential rulings affected by the purpose of enticing Islam, and highlight the extent of the influence of the purpose of enticing Islam on jurisprudential rulings. | ||
