| Abstract | ||
| يتناول البحث بعض الظروف التي تطرأ على عقد الإجارة، وتجعل تنفيذ العقد مستحيلًا، أو على الأقل مرهقًا لأحد الطرفين، وهنا يكون السؤال حول حقوق الطرف الآخر الذي يتضرر بلا شك من فسخ العقد، فهل يمكن تعويضه أو الحكم بتعويضه عن فسخ العقد، مؤجِّرًا كان أم مستأجرًا، أم أن ذلك غير جائز؟، ويتكون البحث من مقدمة، وتمهيد، ومبحثين، وخاتمة. وقد تناولت المقدمة مدخلًا للتعريف بالموضوع، ومشكلة البحث، وأهدافه، ومنهج البحث، وخطته، وأما المبحث الأول فبعنوان: «أسباب فسخ عقد الإجارة»، ويتحدث عن فسخ عقد الإجارة بهلاك العين المؤجرة أو الامتناع عن تنفيذه، وفسخ عقد الإجارة بالعذر الطارئ، وفسخ عقد الإجارة بموت أحد العاقدين، وأما المبحث الثاني فبعنوان: «كيفية التعويض عن فسخ عقد الإجارة»، ويتحدث عن حكم التعويض عن فسخ عقد الإجارة، وإجراءات التعويض عن فسخ عقد الإجارة. وقد انتهى البحث إلى أن التعويض عن فسخ الإجارة في أي صورة من صوره أمر يمضي مع القاعدة العامة للمعاملات في الفقه الإسلامي، ويتفق معه في ذلك نظام المعاملات المدنيَّة السعودي. وأوصى الباحث بالاهتمام بالدراسات المقارنة بين الفقه الإسلامي والأنظمة؛ لأنها تبين للناس مدى ارتباط الأنظمة بالفقه، ومدى صدورها مستندة إلى أحكامه، متبنية القول الذي يساير العصر منها. The topic deals with some of the circumstances that occur in the lease contract and make the implementation of the contract impossible, or at least burdensome for one of the parties. Here the question is about the rights of the other party who is undoubtedly harmed by the termination of the contract. Is it possible to compensate him or award compensation for the cancellation of the contract, whether he is lessor or lessee? Or is that not permissible? The research consists of an introduction, a preface, two sections, and a conclusion. The introduction dealt with an introduction to the subject, the research problem, its objectives, the research methodology, and its plan. As for the first section, it is entitled: Reasons for canceling the lease contract, and it talks about canceling the lease contract by the destruction of the leased property or refraining from implementing it, canceling the lease contract with a contingent excuse, and canceling the lease contract by death. One of the contracting parties. The second section is entitled: How to compensate for the cancellation of the lease contract, and it talks about the ruling on compensation for the cancellation of the lease contract, and the procedures for compensation for the cancellation of the lease contract. The research concluded that compensation for termination of the lease in any form is consistent with the general rule of transactions in Islamic jurisprudence, and the Saudi civil transactions system agrees with it in this regard. The researcher recommended paying attention to comparative studies between Islamic jurisprudence and systems, because they show people the extent to which systems are related to jurisprudence, and the extent to which they were issued based on its rulings, adopting the view that is in keeping with the times. | ||
