Abstract
درج المشرع المصري، ولا يزال، منذ إصداره أول تشريع مكتوب لتنظيم إجراءات التقاضي أمام المحاكم المدنية والتجارية عام ١٨٨٣، على توزيع الاختصاص بنظر الدعاوى أمام محكمة الدرجة الأولى على محكمتين، تسمى إحداهما المحكمة الجزئية، وتسمى الثانية المحكمة الابتدائية وتعرف في العمل بالمحكمة الكلية. وقد قيل إن السبب في هذا التوزيع هو أن بعض الدعاوى تكون قليلة الأهمية بحسب قيمتها أو طبيعتها، بحيث لا تستأهل انتقال المتقاضين من القرى أو المدن الصغيرة إلى المدن الكبيرة حيث توجد المحاكم الابتدائية، لا سيما وأن عددها كان قليلا للغاية -على ما سنبينه تفصيلا- وذلك بسبب قلة عدد القضاة حينئذ. واستمر هذا التوزيع في الاختصاص ينتقل مع كل قانون جديد للمرافعات. ونرى أن هذه الدواعي قد زالت الآن بعد أن انتشرت المحاكم الابتدائية انتشارا يكاد أن يتطابق مع المحاكم الجزئية في معظم المدن المصرية. فضلا عما أسفرت عنه التجربة العملية من طول أمد التقاضي إما بسبب تغيير قواعد توزيع الاختصاص من وقت لآخر، أو تعمد بعض المتقاضين إقامة دعاواهم أمام محكمة غير مختصة مع علمهم بأن قضاء حتميا سيصدر بعدم الاختصاص والإحالة إلى المحكمة المختصة، وذلك بهدف كسب بعض الوقت في مواجهة خصومهم، وهو ما يضر بفكرة العدالة، فضلا عن إرهاق القضاة ومعاونيهم في مسائل شكلية تنال من وقتهم وجهدهم الذي ينبغي أن يتوجه لموضوع النزاع المعروض عليهم.
 
Abstract:
Since the Egyptian legislature issued the first written legislation regulating litigation procedures before civil and commercial courts in 1883, it has been the practice of the Egyptian legislature to distribute the jurisdiction to hear cases before the court of first instance to two courts, one of which is called the Magistrate's Court and the other is called the County Court. It was said that the reason for this distribution was that some cases are of little importance according to their value or nature, so that it is said that it is not accepted for litigants to travel from villages or small towns to large cities where the courts of County Courts are located, especially since they are few- as we will show in detail- due to the small number of judges at that time. This distribution of jurisdiction continued with each new law of pleadings. We believe that these reasons have now disappeared, as the County Courts have spread almost identically to the magistrates' courts in most Egyptian cities. In addition, practical experience has resulted in the prolongation of litigation either due to changing the rules of allocation of jurisdiction from time to time, or some litigants deliberately file their cases before a court that is not authorized knowing that a court will inevitably issue a ruling of lack of jurisdiction and referral to the authorized one.
