| Abstract | ||
| يهدف البحث إلى إظهار مدى توافق المنظم السعودي مع الفقه الإسلامي، والقواعد العامة في الشريعة؛ من خلال دراسة وتحليل نصوص النظام المتعلقة بموضوع الدراسة. ويعتمد البحث المنهج الوصفي. وأهم نتائج البحث: أن نظام المعاملات المدنية، جعل الحلول لمشكلة نقصان الانتفاع بسبب جهة عامة، محصورًا في الفسخ أو إنقاص الأُجْرة، بيد أن سعة الشريعة الإسلامية وقواعد الفقه الإسلامي، جاءت مستوعبة للحلول التي ذكرها النظام وزيادة، فمع الفسخ، أو إنقاص الأُجرة، يمكن إلزام الجهة العامة بتعويض المستأجر عن النقصان الذي تسببت فيه، وتكون هذه الحلول بحسب حجم النقصان وأثره على المستأجر، ويخضع ذلك إلى تقدير القضاء. وأعدل الحلول لهذه المشكلة، هو إلزام الجهة العامة بتعويض المستأجر مقابل نقص الانتفاع؛ لأن في هذا الحل ربط التعويض بالمتسبب في النقصان، ويجد هذا الحل أساسه الشرعي في قواعد الشريعة المانعة من الضرر، وقواعد الفقه، التي تقضي بإسناد الضمان، وجبر الضرر على المتسبب فيه عند انفراده. أما القضاء الإداري قبل صدور النظام، فلم يستقر على اجتهاد قضائي موحد لهذه المشكلة، بل تعدد الاجتهاد فيه، ما بين إلزام الجهة العامة بتعويض المستأجر، وما بين رفض التعويض، وإحالة المستأجر إلى إقامة دعوى الفسخ فقط؛ لوقف الضرر الواقع عليه. The purpose of the research is to show the extent to which the Saudi organization conforms to Islamic jurisprudence and general rules of sharia law by studying and analysing the provisions of the system on the subject of the study. The research adopts the descriptive approach. The most important results of the research are that the civil transactions system has made solutions to the problem of underutilization due to a public entity limited to avoidance or reduction of wages. However, the capacity of Islamic sharia law and the rules of Islamic jurisprudence have been absorbed by the solutions mentioned by the system and have increased. With avoidance or reduction of wages, the public authority may be obliged to compensate the tenant for the decrease caused by it. These solutions are based on the size of the decrease and its impact on the tenant, and are subject to judicial assessment. The most fair solution to this problem is to require the public body to compensate the tenant for the lack of use; in this solution, the compensation is linked to the cause of the decrease, and the legal basis for this solution is found in the sharia rules prohibiting harm, and the rules of jurisprudence providing for the attribution of security and reparation to the person who caused it when he or she was alone. Prior to the promulgation of the system, the administrative courts had not established a uniform case law on the problem. Rather, there was a variety of jurisprudence between the obligation of the public body to compensate the tenant, the refusal of compensation and the referral of the lessee to the institution of a suit for avoidance, in order to stop the damage suffered. | ||
