Abstract
 يُعني هذا البحث ببيان حدود مسئولية الناقل البري للبضائع الناشئة عن عقد النقل البري للبضائع، وذلك من خلال مبحثين يتناول الأول: الحدود الاتفاقية لمسئوليته، وقد قسمته إلى ثلاثة مطالب تناولت في الأول حالات الاتفاق على إعفاء الناقل البري للبضائع من المسئولية أو التخفيف منها، وفي الثاني حالات الاتفاق على تشديد المسئولية، وفي الثالث حالات الاتفاق على تحديدها، وذلك بشكل مقارن بين ما ورد في نظام المحكمة التجارية لعام 1350ه ولائحة وزير المواصلات لعام 1441هـ، وفي المبحث الثاني تناولت الحدود النظامية لمسئولية الناقل البري للبضاعة في لائحة وزير المواصلات 1441هـ فقط، دون نظام المحكمة التجارية إذ لم يرد في الأخير تحديد لها، وقد تناولته في ثلاثة مطالب: تناولت في الأول حدود مسئولية الناقل البري للبضاعة في اللائحة في حال الأضرار المباشرة وفي الثاني مسئوليته عن الأضرار غير المباشرة، وفي الثالث الإشكالات النظامية في تطبيق لائحة وزير المواصلات، وقد توصلت إلى عدد من النتائج أهمها أن نظام المحكمة التجاريةـ نظم قواعد مسئولية الناقل البري للبضائع دون أن يحدد حدود مسئوليته وأجاز للمتعاقدين الاتفاق على إعفاء الناقل من المسئولية أو تخفيفها أو تشديدها، بخلاف لائحة وزير المواصلات التي حددت مسئولية الناقل البري وأبطلت الشروط التي تعفي أو تخفف مسئوليته، كما انتهيت إلى مجموعة من التوصيات أهمها توصية المنظم السعودي بإعادة إصدار اللائحة من خلال مرسوم ملكي لتبلغ مرتبة النظام، مع إلغاء العمل بنصوص نظام المحكمة التجارية المقابلة.
 
Abstract:
 This research means a statement of the limits of the liability of the land carrier of goods arising from the contract of land carriage of goods, through two sections dealing with the first: the boundaries of the agreement for his responsibility, has divided it into three demands dealt with in the first cases of agreement to exempt the land carrier of goods from liability or mitigation, and in the second cases of agreement to tighten responsibility, and in the third cases of agreement to determine, in a comparative manner between what was stated in the system of the Commercial Court for the year 1350 AH and the regulation of the Minister of Transport for the year 1441 AH, and in The second section dealt with the statutory limits of the liability of the land carrier of the goods in the list of the Minister of Transport 1441 AH only, without the system of the Commercial Court, as it was not contained in the latter to determine them, and I dealt with it in three demands: In the first, it dealt with the limits of the liability of the land carrier of the goods in the regulation in the event of direct damages, in the second its responsibility for indirect damages, and in the third the systemic problems in the application of the regulation of the Minister of Transportation, and it reached a number of results, the most important of which is that the Commercial Court system regulated the rules of liability of the land carrier of goods without specifying the limits of its liability and allowed the contractors to agree to exempt, mitigate or tighten the carrier from liability, unlike the regulation of the Minister of Communications, which determined the responsibility of the land carrier and invalidated the conditions. Which exempts or mitigates his responsibility, and I also concluded with a set of recommendations, the most important of which is the recommendation of the Saudi regulator to re-issue the regulation through a royal decree to reach the rank of the system, with the abolition of the provisions of the corresponding commercial court system.
