| Abstract | ||
| فلولا فضل الله علي لما تمّ واكتمل هذا البحث الموسوم" تتبع الرخص وأثره في القضايا الفقهية"، فقد انتظم هذا البحث في خمسة مباحث، وخاتمة، وقائمة بالمصادر والمراجع. أما المبحث الأول فقد تناولت فيه حقيقة تتبع الرخص، وقد ظهر لي أن المقصود منه هو مبالغة السائل في الأخذ مِن أقوال العلماء في المسائل الخلافية ما يناسِبُ سؤاله من غير نظَرٍ في الراجح من الأقوال، والمرجوح منها؛ لموافقة أهوائه وتحقيق لرغباته. وأما المبحث الثاني فقد كشف اللثام عن محل الخلاف في تتبع الرخص هو تتبع الرُّخَص إن كان لغير التشهِّي واللهو؛ كضرورة أو حاجة، وقد اختلفوا فيه على ثلاثة أقوال. وأما المبحث الثالث فقد بيّنت فيه المفاسد المترتبة على تتبع الرخص ومنها: أن في تتبع الرُّخَص مخالَفةً لأصول الشريعة ومقاصدها، وأنه ينتج عن ترك اتباع الدليل اتباعُ الخلاف. وأما المبحث الرابع فقد ذكرت فيه صور تتبع الرخص التي تقع من المفتين والمستفتين. وأما المبحث الخامس فقد ذكرت بعض القضايا الفقهية التي انتشر بين الناس الأخذ بها بناءً على الأيسر من الأقوال. Had it not been for the grace of Allah upon me, this research entitled “Pursuing al-Rukhas and its Impact on the Issues of Fiqh” would not have been completed and accomplished. This research was organized into five sections, a conclusion, and a list of sources and references. As for the first section, I dealt with the reality of pursuing al-Rukhas, which was meant by the seeker’s exaggeration in taking from the sayings of scholars which agree with his whims and fulfill his desires on controversial issues without considering which of the sayings is more correct. As for the second section, it highlighted the point of contention concerning pursuing al-rukhas, which is pursuing al-rukhas if they are for something other than desire and amusement, rather, as a necessity or need, they differed on three opinions about it. As for the third section, I explained in it the evils resulting from pursuing al-rukhas, including: that pursuing al-rukhas violates the principles and objectives of Sharia law, and that abandoning following the evidence results in following disagreement. As for the fourth section, I mentioned examples of al-rukhas granted by muftis and seekers. Regarding the fifth section, I discussed a few issues in Fiqh that were widely accepted among people based on the easiest of the sayings. | ||
