| Abstract | ||
| الملخـص: يهدف هذا البحث إلى بيان موقف أحد علماء الأمة بقضية أجدها من أهم القضايا التي تدلل على صلاحية الشريعة الإسلامية، ومواكبتها لمستجدات العصر في كل زمان ومكان؛ وذلك من خلال التأصيل لقضية الاجتهاد، وبيان أثر ذلك في المستجدات العصرية. فتحدثت عن موقف الإمام المراغي – رحمه الله – من قضية الاجتهاد؛ باعتباره أحد شيوخ الأزهر الذين كان لهم الأثر البارز في إصلاح الأزهر وتجديده. وقد اتبعت المنهج الاستقرائي التحليلي، وكان من أهم ما توصلت إليه من نتائج: إمكانية تحقق الاجتهاد المطلق والجزئي لدى الشيخ المراغي – رحمه الله - بل يرى أنهما أمر ميسور، وفي أهون مستطاعنا. كما يرى – رحمه الله – أنه لن يستطيع العلماء سد باب الاجتهاد في المذهب؛ لاختيار رأي يلائم عرفاً عاماً أو خاصاً أو رأي قضت به ضرورة عامة؛ بل إن هذا هو الفقه الذي لا يمكن لشخص يقدر عقله أن يحيد عنه، كما يرى رحمه الله أن الاجتهاد في المذهب لم ينقطع في أي عصر من العصور الماضية، وهو باق إلى الآن. ويرى أنه يجوز تقليد غير الأئمة الأربعة؛ متى صح النقل عنهم، وفهم مرادهم، كما يرى رحمه الله أن التقيد بتقليد المذاهب الأربعة، يعتبر رأياً حادثاً في الأمة الإسلامية؛ حيث إن المسلمين مجمعون على جواز تقليد أي عالم من علماء المسلمين، وأن تقليد إمام من غير معرفة دليله لمن يستطيع النظر في الأدلة، وفهمها، وترجيح دليل على دليل، أمر يأباه الدين، وتأباه أيضاً أقوال الأئمة – رحمهم الله - ؛ بل لم يكن ذلك معروفاً في الصدر الأول، ولم يكن يرضاه أحد لنفسه. فكانت الوصية الواجبة، وتوثيق عقود الزواج بالنظام المتعارف عليه، وغير ذلك من المسائل المستحدثة من ثمرات اجتهاد شيخنا المراغي رحمه الله. Imam Al- Maraghi’s Attitude towards the Issue of Diligence (An Exposition and Study) By: Amira Taha Abdel- Aziz Abdel- Zaher Department of Fundamentals of Jurisprudence Faculty of Islamic and Arabic Studies in Cairo Azhar University, Cairo, Egypt Email: AmiraAbdalzaher.2057@azhar.edu.eg Abstract: This research paper aims at clarifying the attitude of one of the nation’s scholars towards an issue that the researcher considers one of the most important ones proving the validity of the Islamic Sharia as well as keeping up with the developments of every time and place. This objective can be fulfilled through tracing the issue of diligence displaying its impact on the modern developments. Accordingly, this research paper has highlighted the attitude of Imam Al- Maraghi (May Allah have mercy on him) towards the issue of diligence. Sheikh Al- Maraghi was one of the former Grand Imams of Al-Azhar Al- Sharif who had a prominent impact on reforming and renovating Al-Azhar. This research paper has applied the inductive and analytical approaches. This paper has concluded with the most important findings. For example, the paper has drawn attention to the possibility of accomplishing both absolute and partial diligence for Sheikh Al-Maraghi (May Allah have mercy on him) as he saw them affordable and so easy to achieve. In addition, Sheikh Al- Maraghi (May Allah have mercy on him) saw that scholars would never be able to block the way before diligence within the school of jurisprudence for choosing an opinion that suits a general or specific custom or an opinion dictated by a general necessity, but it is rather the jurisprudence from which a person who values his mind could not deviate. Moreover, Sheikh Al- Maraghi (May Allah have mercy on him) saw that diligence within the school of jurisprudence had never been suspended at any age in the past, and it has remained until now. For Sheikh Al- Maraghi, it is permissible to imitate others, rather than the four Imams of jurisprudence, as long as transmission after them is truthful and their objective is comprehensible. Sheikh Al- Maraghi (May Allah have mercy on him) also believes that adhering to the imitation of the four schools of thought is considered a new opinion for the Islamic nation, as Muslims unanimously agreed on the permissibility of imitating any Muslim scholar, and that imitating an Imam without knowing his evidence- for someone who can examine evidence, understand it, and give preponderance to certain evidence rather than another, is something that religion and the sayings of the Imams (May Allah have mercy on them) forbid. In fact, it was not known in the early days, and no one would accept it. Thus, the obligatory will, the documentation of marriage contracts according to the accepted system, and other new issues constitute the outcome of the efforts of Sheikh Al-Maraghi (May Allah have mercy on him). | ||
