| "ردّ العمل بحديث الصحابيّ غير الفقيه إذا خالف أصول القياس بين فقهاء الحنفيّة وعلماء الحديث" دراسة فقهيّة حديثيّة بينيّة ([1]) عبد الله خالد المطر& يوسف عبد الرحيم المهيني تخصص الفقه وأصوله ، قسم الدراسات الإسلامية ، كلية التربية الأساسية، الكويت. البريد الإلكتروني: abdullahkhalid77@gmail.com الملخـص: يقدّم هذا البحث مناقشة تحليلية نقديّة للجدل الدائر في مسألة تقديم رواية الصحابي غير الفقيه على القياس أو العكس، فيقتصر البحث على تحليل القاعدة الأصوليّة الفقهيّة المشتهرة عند بعض فقهاء الحنفية، التي تقضي بردّ حديث الصحابي غير الفقيه بحسب النظر الأصولي عندهم إذا خالف القياس الذي هو القواعد والأصول الشرعية العامة حسب تعبيرهم، كما يرتكز صلبه أيضًا على مطالعة وتحليل ما يسند هذه القاعدة في الممارسة العملية لسلف الأمة الأوائل من الصحابة ومن بعدهم من أهل الحديث، كمسألة الرواية بالمعنى، ومسألة ضبط الراوي، ومسألة النظر في التطبيقات العملية للأحاديث التي تخالف القياس من خلال بحث هذه المسائل وفحصها والبحث عن ما يؤيد فقهاء الحنفية في تعزيز قاعدتهم وإظهارها، أو ردّها، كلّ ذلك وفق إطار علمي منهجي في هذه الدراسة. Disapproving the Hadith of a non- Jurist Companion if it contradicts the Principles of Analogy in between Jurists of the Hanafi School and Hadith Scholars An Interdisciplinary, Jurisprudential and Hadith Study By: Abdullah Khaled Al-Matar & Yousef Abdulrahim Al-Muhaini Majored in Jurisprudence and its Fundamentals Department of Islamic Studies College of Basic Education The State of Kuwait abstract: This research paper displays an analytical and critical discussion of the ongoing controversy around the issue of giving precedence to the narration of a non-jurist companion over analogy or vice versa. Hence, this research paper is confined to analyzing the fundamental, juristic rule known for some Hanafi scholars and which requires disapproving the Hadith of a non-jurist companion according to their fundamentalist view if it contradicts analogy which constitutes the general legitimate principles and foundations according to their expression. Moreover, the core of this research paper is based on studying and analyzing what supports this rule in the practical work of the nation’s early predecessors from the companions of Prophet Muhammad (Peace be upon him)and those who came after them from the people of Hadith, such as the issue of narration by meaning, the narrator’s accuracy, examining the practical applications of Hadiths that contradict analogy by researching and examining these issues in search of what supports the Hanafi jurists to strengthen their rule and reveal or disapprove it. All of that is carried out according to an academic, methodological framework as seen in this research paper. | ||
