| موقف شيوخ الجامع الأزهر من الإيصاء بأعضاء البدن "دراسة فقهية مقارنة" محمد عبد الله أحمد إبراهيم قسم الفقه المقارن، كلية الدراسات الإسلامية للبنين ، جامعة الأزهر ، أسوان ، مصر. البريد الإلكتروني: alazharymohamed366@gmail.com ملخص البحث: إن التطور الهائل في حياة الإنسان تقنيًا وطبيًا وتجريبيًا حديثًا وغير ذلك، أوقف الإنسان على ماهية وحقيقة بعض الأمراض، من خلال فحصها فحصًا دقيقًا متقدمًا، ومن ثَم اكتشف أنواعًا من الأدوية لهذه الأدواء، بيد أن الإنسان مهما تطور فإن العجزَ صفتُه، وانتهاءَ العقل إلى حده في التفكير نعتُه، لذا فإن الحوادثَ التي تفسد بعض أعضاء البدن، والأمراضَ التي تعطب جهازا من أجهزة الإنسان، لم يتوصل إلى أي دواء لها ذي أثر ملحوظ، وكان قد انقدح في رأس الإنسان نقلُ الأعضاء من قديم الزمان، وكيف أن الإنسان منذ قرون كان يردُّ سِنَّه إذا سقطت، وكذلك تكلم الفقهاء عن استبدالها سِنَّ حيوانٍ، ــ حكم ذلك كما سنرى ــ لكن مع التطور الطبي قفز إلى السطح موضوع زراعة عضو إنسان في إنسان آخرَ، فاهتم علماء الشرع بهذه القضية خاصةً علماءَ الأزهر المعمور، وفي هذا البحث أتناول موقف شيوخ الجامع الأزهر في هذه القضية المعاصرة بخصوصها، وما استندوا إليه من منقول ومعقول وما استأنسوا به من معهود الفقهاء المتقدمين، وكيفية تخريج هذه القضية على عتيق مسائلهم وعريق بحوثهم. By: Muhammad Abdullah AhmThe Attitude of the Grand Imams of Al-Azhar Mosque towards Recommending Organs of the Body “A Comparative Jurisprudential Study”ed Ibrahim Department of Comparative Jurisprudence Faculty of Islamic Studies for Men in Aswan Azhar University, Egypt Email: alazharymohamed366@gmail.com Abstract The tremendous development of human life, technically, medically, experimentally, etc., has made man aware of the nature and reality of some diseases through examining them precisely by means of advanced examinations. Accordingly, man managed to discover types of medicines for these diseases. Although man has achieved a great deal of progress, he remained impotent and his mind is besieged intellectually. Therefore, the accidents which damage organs of the body and the diseases that damage one of the systems of the human body had their noticeable influence as man has not found any cure for them. Hence, the idea of organ transplant has been around for a long time. How did man restore his tooth if it fell down? The jurists talked about replacing that tooth with one from an animal- the ruling of this transplant would be seen afterwards- but due to the medical advancement, the idea of transplanting an organ from one person to another came to the ground. For this reason, scholars of the Islamic Sharia especially those of the prosperous Al- Azhar paid great attention to this issue. Consequently, this research paper has traced the attitude of the Grand Imams of Al- Azhar towards this contemporary issue in particular and what they relied on with regard to the transmitted and rational evidence. The paper has also referred to what the Imams of Al- Azhar relished in the customs of the early jurists. Finally, the research paper has given clue to authenticate this issue in accordance with their ancient remarks and their deep research. | ||
