| موقف شيوخ الأزهر الشريف من تحديد نوع الجنين محمد حسين ضيفي حسن قسم الفقه العام- كلية الدراسات الإسلامية للبنين- جامعة الأزهر.أسوان ، مصر. البريد الإلكتروني: m.hussein76@azhar.edu.eg الملخـص: فإن المستجدات الطبية شهدت تطوراً هائلاً في العلوم التقنية في العصر الحاضر ومن بين هذه المستجدات تحديد جنس الجنين كواحدة من أهم التقنيات التي أثارت جدلاً واختلافاً في المجتمعات الإسلامية، ولما كان الأزهر الشريف أهم وأقدم المراكز الدينية والتعليمية في العالم الإسلامي وتأثيره بارز على المسلمين في جميع أنحاء العالم؛ لذا فإني في هذا البحثِ تناولت أنظارَ شيوخِ الأزهرِ الشريفِ في هذه القضيةِ (حيث إنهم فرقوا بين التحديد على المستوى الشخصي والمستوى الجماعي، وذلك لما هو مقررٌ شرعاً اختلاف الفتوى باختلافِ تعلقِ الحكمِ) فمعالجةُ هذا الأمرِ على المستوى الجماعيِ فالأمرُ يختلفُ لأنه يؤدي إلى اختلالٍ واضطرابٍ في التعادلِ العدديِّ بين الذكرِ والأنثى الذي هو عاملٌ مهم من عواملِ استمرارِ التناسلِ البشري ويكون في هذه الحالة بمثابة الاعتراض على الله تعالى في خلقه بخلخلةِ البيانِ وهدمِ النظامِ الكوني، أما معالجة المسألة على مستوى الفردِ فقد أجازوا التحديد بضوابطه، لذا تناولت أقوالَ وأدلةَ من عارضَهم وقمت بالموازنة بين الأقوالِ والآراءِ حتى تبين لي أرجحيةٌ أقوالِ شيوخِ الأزهريِ من خلال الأدلةِ الفرعيةِ والقواعدِ الأصوليةِ بالضوابط الشرعية التي ذكرت. The Attitude of the Grand Imams of Al- Azhar Al- Sharif towards determining the Gender of the Fetus By: Mohammed Hussein Dhaifi Hassan Department of General Jurisprudence Faculty of Islamic and Arabic Studies for Men in Aswan Azhar University, Egypt Abstract: Medical developments have experienced tremendous progress in technological sciences of the modern age. One of such developments is determining the gender of the fetus which embodies one of the most important techniques that has caused controversy and differences within the Islamic societies. Being one of the most important as well as the oldest religious and educational institutions in the Islamic world, Al-Azhar Al-Sharif has its dominant influence on Muslims worldwide. Consequently, this research paper traces the viewpoints of the Grand Imams of Al- Azhar Al- Sharif concerning this issue (as they differentiated between personal and collective determination since the fatwa legitimately varies in accordance with the circumstances). Handling this issue, from a collective perspective, differs because it may lead to numerical disequilibrium and disruption between males and females, which is an important factor in the continuation of human reproduction. Accordingly, this case is taken as an objection to the will of Almighty Allah in His creation by disrupting the discipline and destroying the cosmic order. As for the individual perspective, it is permissible to determine the gender of the fetus in certain conditions. Therefore, this research paper has demonstrated the views and evidence of the Imams of Al- Azhar as well as the ones that opposed them. The research paper has concluded that the views of the Grand Imams of Al- Azhar are preponderant relying on the sub- evidence and the fundamental rules in accordance with the legitimate criteria stated in this study.
