| Abstract | ||
| إن موضوع الفتوى من الموضوعات المهمة، ولها مكانتها في الشريعة الإسلامية الغراء، ومن الأحكام المتعلقة بها حماية مقام الفتوى ممن ليسوا لها بأهل، وخصوصاً في العصور المتأخرة، الذي تصدى للفتوى فيه بعض ممن ليسوا بأهل لها؛ فأفتوا في قضايا تتعلق بمصير الأمة الإسلامية؛ تسببت في انتشار الفكر المتطرف، وشق عصا الطاعة، وتفرق المجتمعات، واتهام الدين الإسلامي الحنيف بالتشدد والتطرف والإرهاب وهو منها براء، وخاصة مع سرعة انتشار الفتاوى عبر الوسائل المتعددة، كوسائل التواصل الاجتماعي المختلفة، والفضائيات المتنوعة. وفي هذا البحث يبين الباحث أهمية التمسك بأصالة الفتوى، ورصانتها، ومنهجها المعتدل الذي اتبعه السلف الصالح، حمايةً للفتوى من التشدد والتطرف الفكري، متمسكًا بالأصول الثابتة للفتوى والإفتاء، ملتزمًا بميزان الشرع بعيدًا عن المصالح الخاصة المحضة؛ بغية الوصول إلى التصور الصحيح والتكييف السليم للمتغيرات ومستجدات الحياة والقضايا، والوصول إلى الحكم الشرعي الصواب لها. وكل هذا يفعله صاحب المنهج المعتدل في الفتوى ليؤكد على أن الأحكام الفقهية في الشريعة الإسلامية تتسع لجميع تعقيدات الحياة ومستجداتها، و أن الفتوى لا تنفصل عن الواقع بل تتحد معه، من أجل الوصول إلى صالح البشرية عامةً، وسلامة المجتمعات المسلمة وغير المسلمة من الغلو والتطرف الفكري خاصة، وسيعرض الباحث هذا البحث، في ثلاثة مباحث متتالية موضحًا في المبحث الأول حقيقة الفتوى ومكانتها في الشريعة الإسلامية، وفى المبحث الثاني: حقيقة الأمن الفكري ومشروعيته، وفى المبحث الثالث: أثر الفتوى في حماية الأمن الفكري. The subject of the fatwa is one of the important topics, and it has its position in Islamic law. One of the provisions related to Fatwa is to protect the position of the fatwa from those who are not qualified to issue a Fatwa, notably in contemporary times where individuals lacking the requisite qualifications have engaged in the issuance of fatwas concerning matters pivotal to the destiny of the Ummah (Islamic nation). This practice has catalyzed the propagation of extremist ideologies, precipitated the splintering of allegiances, contributed to societal fragmentation, and unfoundedly implicated the noble Islamic faith with allegations of rigidity, extremism, and terrorism—a character from which Islam is unequivocally exempt, especially with the rapid dissemination of fatwas across varied media, including diverse social media platforms and numerous satellite channels. Within this scholarly endeavor, the author elucidates the imperative of adherence to the foundational tenets of fatwa issuance, characterized by its robustness and the moderate methodology espoused by the righteous predecessors, to protect fatwa from the ideological stringency and extremism. The research underscores the importance of steadfastly clinging to the foundational tenets of fatwa and fatwa issuance, maintaining the equilibrium of Shariah principles devoid of personal biases; thereby, striving towards an accurate comprehension and the right adaptation with life's evolving circumstances and innovations, to deduce the appropriate Shariah verdicts therewith. All this is done through a moderate approach towards fatwa issuance, to assure that the Jurisprudential rulings of Islamic Shariah can encompass the multifaceted complexities and novelties of life, thereby affirming the integrality of fatwa within the fabric of reality, with the ultimate goal of fostering the well-being of humanity at large, and the safety of Muslim and non-Muslim communities from extremism and intellectual extremism in particular. The study is partitioned into three successive sections, delineating firstly the essence and significance of fatwa within Islamic Shariah, secondly the concept of intellectual security and its Shariah-based justification, and thirdly the instrumental role of fatwa in safeguarding intellectual security. | ||
