| Abstract | ||
| تحدث الباحث في هذا البحث علي الزواج بنية الطلاق وصوره المستجدة والزواج بنية الطلاق: هو: أن يتزوج الرجل المرأة، بولي ومهر وشهود وإعلان واستكمال الشروط والأركان، ولكن الزوج يضمر في داخله نية تطليقها بعد زمن معين . ومن مستجداته المسيار أيضا وهو الزواج الشرعي المستوفي للأركان والشروط المتعارف عليها عند جمهور الفقهاء، لكنه يتضمن تنازل الزوجة عن بعض حقوقها الشرعية على الزوج من عدم مطالبته بالمبيت والنفقة، أو المبيت فقط. حكمه: إن زواج المسيار جائز مع الكراهة، وتأتي الكراهة من باب أنه ليس ً الزواج المرغب فيه شرعا. ويهدف هذا البحث إلأي معالجة هذه الزيجات وبيان حكمها الشرعي لدي المعاصرين ، ولهذا الموضوع أهمية كبيرة في المجتمع, وذلك لأنه يتعلق برابطة هي من أهم الروابط التي تبنى عليها المجتمعات, بل ويتوقف عليها بقاء النوع الإنساني بأسره ألا وهي الزواج. وقد توصل الباحث إلي عدة نتائج من أهما تعددت صور الزواج العرفي نظرا لوجود أركان عقد الزواج في بعضها دون بعض، ومن ثم يختلف الحكم الشرعي تبعا لذلك ظهرت أنواع من الزيجات المعاصرة مثل زواج "الفرند" ويقصد به: تزوج الفتى والفتاة دون أن يشترط امتلاكه بيتًا، أو وجوب نفقة على الزوج في بلاد الغرب على أن يوفر لها ذلك حين قدرته. In this research, the researcher talked about marriage with the intention of divorce and its new forms, and marriage with the intention of divorce: it is: for a man to marry a woman, with a guardian, a dowry, witnesses, a declaration, and completion of the conditions and pillars, but the husband harbors within him the intention of divorcing her after a certain time. Among its innovations is Misyar, which is a legal marriage that fulfills the pillars and conditions known to the majority of jurists, but it includes the wife’s waiver of some of her legal rights over the husband by not requiring him to spend the night and maintenance, or just to spend the night. His ruling: Misyar marriage is permissible if it is disliked, and the dislike comes from the fact that it is not the marriage desired by Islamic law. This research aims to address these marriages and clarify their legal ruling among contemporaries. This topic is of great importance in society, because it relates to a bond that is one of the most important bonds on which societies are built, and on which the survival of the entire human species depends, which is marriage. The researcher reached several results, the most important of which is that there are multiple forms of customary marriage due to the presence of the pillars of the marriage contract in some of them but not in others, and then the legal ruling differs accordingly. Types of contemporary marriages have emerged, such as the “friend” marriage, which means: a boy and a girl get married without requiring that they own a house, or that the husband in the West must provide for her, provided that he provides for her when he is able. | ||
