| عُني هذا البحث ببيان المراد بمصطلح الإغلاق الوارد في قول النبي صلى الله عليه وسلم : ((لا طلاق في إغلاق))؛ مبيِّنا تفسيرات هذا المصطلح وفق ما ذكره أئمة اللغة، وشرَّاح الحديث، وفقهاء الشريعة، ذاكراً المعنى الذي ظهر للبحث رُجحانه، ثمَّ اتجه البحث إلى النظر في مدى انطباق الحديث -المتضمن عدم إيقاع الطلاق حال الإغلاق- على المريض النفسي، والمسحور، بعد توصيف حالتيهما، والتكييف الفقهي لطلاقِ كلٍّ منهما، وتحدث الباحث علي حكم طلاق المريض النفسي ، وطلاق المسحور ، والمراد بمصطلح الإغلاق وتوصيفه ، ويهدف هذا البحث إلي محاولة معالجة هذه القضية التي انتشرت في الآونة الأخيرة ، وقد توصل الباحث إلي عدة نتائج * للمريض النفسي عدة حالات يختلف إيقاع الطلاق باختلاف كل حال منها. لم ينص الفقهاء على طلاق المريض النفسي لكنه مخرَّج على طلاق المجنون والغضبان. يعرَّف السحر في الاصطلاح بأنه: "عزائم ورقى وعُقد، تؤثر في الأبدان، والقلوب، فيمُرض، ويقتل، ويفرق بين المرء وزوجه، ويأخذ أحد الزوجين عن صاحبه. لم ينص الفقهاء فيما وقفت عليه على حكم طلاق المسحور سوى الحنابلة، ويمكن تخريجه على طلاق المجنون، والغضبان، والمكره، باختلاف أثر السحر. Abstract: This research dealt with the explanation of the term "coercion" occurring in the saying of the Prophet (PBUH): "No divorce while being in coercion". It touched on the interpretations of this term according to what was mentioned by linguists, commentators of hadith, and jurists of Sharia. The research also declared the meaning that appeared to be the most correct one. The research then tended to consider the extent to which the hadith applies – putting divorce in action in the event of coercion- on the two cases of psychiatric patients and enchanted people, after describing their cases. The jurisprudential adaptation of divorce in each of the two cases was also discussed. The research conclusion included included the most prominent results and recommendations. The jurists did not stipulate the divorce of the mentally ill, but it is permitted to divorce the insane and the angry. Magic is defined in terminology as: “incantations, spells, and knots that affect bodies and hearts, causing illness, killing, separating a person from his wife, and separating one of the spouses from the other. The jurists, as far as I have come across, have not stipulated the ruling on the divorce of a bewitched person except the Hanbalis, and it can be applied to the divorce of an insane person, an angry person, or someone under duress, depending on the effect of the witchcraft.
